Video: David Pecker, Key Figure in ‘Catch and Kill’ Scheme Takes Stand in NY Trial

Law • Views: 13,513

I’m trying so hard to refrain from making (any more) “pecker” jokes, I should get a medal.

Vaughn Hillyard, NBC News Correspondent, Susanne Craig, New York Times Investigative Correspondent and Lisa Rubin MSNBC Legal Correspondent joins Nicolle Wallace on Deadline White House with reaction to the first day of opening arguments in the hush money trial in New York involving Donald Trump with David Pecker who was at the center of the catch and kill scheme taking the stand.

No pecker jokes here.

So great. Automatic sails of different styles retract when docking. Didn’t know this was happening, but am delighted.

Video from the scene showed faculty members forming a wall around student protesters as they defied the 4 p.m. order to leave.

“…If you’re not familiar, Tesla really wants you to put your car in Drive or Park using the touchscreen. Since touchscreens can crash, though, you need a second way to get your car into gear. So Tesla put a panel in the middle of the windshield that allows you to put it in Drive yourself. The sun visors also attach to the same panel when in use.
Since sun visors get so much use, and moving them puts strain on whatever they’re mounted to, you’d assume Tesla would have done enough durability testing to make sure the plastic could stand up to repeated use. Apparently, you’d also be wrong.”

It accurately speaks to how conservatives view distribution of power—they are special, they deserve unaccountable power, they do not have time to quibble over meaning with inferiors. The “argument” makes perfect sense once you realize that their assumption is only they can hold power legitimately.

Trump succeeds with his audience because he speaks the language of exclusivity and caste they value first and foremost.

I’m just going to say that students now are much more active in getting into their universities’ faces than we were in the fall of 1982. We were protesting UT Austin’s Permanent University Fund being (partially) invested in companies that did business in apartheid South Africa. Yeah, there were sit-ins, yeah, there were arrests, but man, the profs did NOT join us. It never occurred to us to get tents and camp out on the West Mall.

I have seriously mixed emotions about this. On the one hand, it’s good to see students interested in the outside world. On the other hand, I’m not sure this is going to do anything. I don’t know if these people *get* that it’s not going to take a week or a month. The protesting went on for *years* at UT Austin, up until the end of apartheid in 1990. Also, the involvement of outsiders is sketchy as hell.

Meanwhile, the from-the-river-to-the-sea folks have set up tents on the Sproul steps (central, but out of the way of the main traffic) and say they’ll be there until UC divests from “pro-Israel” investments. Their pro-genocide chants do not endear me to them (yes, Israel has a lot to answer for in the way they’re prosecuting their war, but.).

My best guess is that they’ll wait until the semester ends (three weeks), then remove the tents and their occupants (it seems they still remember the lessons of People’s Park). Unless the protesters get too obnoxious. The administration is an authoritarian institution, and it’s a bad idea to poke them.

Belafon  Apr 22, 2024 • 6:45:18pm

I personally would still like to see us try to put humans on the moon and Mars for both scientific and engineering reasons. But, one thing that would aid us in any exploration of the Solar System is an array of communication satellites scattered throughout local space.

For the first time since November, NASA’s Voyager 1 spacecraft is returning usable data about the health and status of its onboard engineering systems. The next step is to enable the spacecraft to begin returning science data again. The probe and its twin, Voyager 2, are the only spacecraft to ever fly in interstellar space (the space between stars).

Voyager 1 stopped sending readable science and engineering data back to Earth on Nov. 14, 2023, even though mission controllers could tell the spacecraft was still receiving their commands and otherwise operating normally. In March, the Voyager engineering team at NASA’s Jet Propulsion Laboratory in Southern California confirmed that the issue was tied to one of the spacecraft’s three onboard computers, called the flight data subsystem (FDS). The FDS is responsible for packaging the science and engineering data before it’s sent to Earth.

The team discovered that a single chip responsible for storing a portion of the FDS memory—including some of the FDS computer’s software code—isn’t working. The loss of that code rendered the science and engineering data unusable. Unable to repair the chip, the team decided to place the affected code elsewhere in the FDS memory. But no single location is large enough to hold the section of code in its entirety.

[…]

The team started by singling out the code responsible for packaging the spacecraft’s engineering data. They sent it to its new location in the FDS memory on April 18. A radio signal takes about 22.5 hours to reach Voyager 1, which is over 15 billion miles (24 billion kilometers) from Earth, and another 22.5 hours for a signal to come back to Earth. When the mission flight team heard back from the spacecraft on April 20, they saw that the modification had worked: For the first time in five months, they have been able to check the health and status of the spacecraft.

Yes, the signal would get to and from destinations slower because it wouldn’t be in a straight line most of the time, but it would be a stronger signal on both ends.

Hey rock fans, the official Midnight Special YouTube channel has given us our first Todd Rundgren drop!

Black Maria - Todd Rundgren | The Midnight Special

This was the night he largely tanked his career. At the time, he was just a few months after a top 10 hit with “Hello It’s Me”. Fans who only knew him from AM radio at this point were…um…surprised by his appearance here, even if few picked up on the fact he was under the influence of psychedelics.

Coincidentally, I just saw him perform for the first time in 6 years this past Saturday night. His recently started tour is about as “deep cuts” as he ever gets. It’s also less talk/more rock…least I have ever heard him patter in my 30+ shows over the past 38 years. The result is 2+ hours of good and thoughtful music. If you are any kind of fan of his, this tour is well worth seeing and not priced as obnoxiously as a LOT of shows these days.

Just incredible news on reviving Voyager I.

Think of it: a computer chip 15 billion(!) miles away is broken. The solution is to repackage & move key software, w/ code sent via radio signal that takes 22+ hrs to reach that little 46yr old machine.

AND IT IS WORKING.

So, today is a milestone in my life. A chance I took 20 years ago finally bears fruit.

I left Immunex as a research scientist (where I had been involved in the research in what became Enbrel) after Amgen bought it in 2002. In 2004, I became Head of Research at a company - with now 3 FTEs - called Etubics (as well as being on the Board). This company had new technology that changed how we develop not only vaccines but cancer therapies. To keep costs down, I took my salary in stock.

We were very successful on the research side (there were only 3 of us but we generated over $10 million in non-dilutive SBIR grants from the government). After taking it as far as we could, we sold the company in 2016 to a company called Nantworks with the merged company called ImmunityBio.

My Etubic shares got transferred into ImmunityBio shares. For 20 years, my surrogate salary was a bunch of stock. I wondered if I had done the right thing. Science-wise it was great.

Lots of clinical trials and possible cancer therapies as well as possible disease vaccines were a real possibility. But I have had to wait 8 years for my shares to really be worth anything close to the salary I gave up in order to work at Etubics.

Today is the day. The FDA approved ImmunityBio’s therapy for bladder cancers that are refractory for any other therapy. This is the first in a slew of novel cancer therapies from ImmunityBio based more on modifying the immune system to attack the cancer rather than drugs.

It is great to have been part of something like this. Helping people is why I got into biotech research. And I am glad I was able to not require a salary in order to get that work done. But it is nice that the stock is worth something now. A real win-win for everyone.

Here is the PR put out by the company. Has a lot of good science. I’m amazed it will be available in a month.

Highlights:

Designated an FDA Breakthrough Therapy, the novel immunotherapy ANKTIVA activates the body’s natural killer (NK) and killer T-cell immune system to attack tumor cells

Therapy stimulates memory T cells, leading to long duration of complete response exceeding 47 months.

The duration of response is ongoing, so the final median duration of response has yet to be determined.

The CR (complete recovery) rate for the 77 evaluable patients was 62% with the upper end of the confidence interval being 73%.

ANKTIVA in combination with BCG is approved for maintenance therapy for up to 37 months with tolerable side effects ranging from 0% to 3% Grade 3/4 adverse events

ANKTIVA is expected to be available in the U.S. by mid-May 2024

They have not been able to determine a median response because so many are still in remission.

Quote from Russian mathematician V. I. Arnol’d:

It is almost impossible for me to read contemporary mathematicians who, instead of saying “Petya washed his hands,” write simply: “There is a t_1 < 0 such that the image of t_1 under the natural mapping t_1 -> Petya(t_1) belongs to the set of dirty hands, and a t_2, t_1 < t_2 <= 0, such that the image of t_2 under the above-mentioned mapping belongs to the complement of the set defined in the preceding sentence.”

Don’t know who the mathematician is, but the sarcastic remark basically states that mathematicians can’t just make a simple statement.

This shit has happened so many times I’ve lost count. A corporation that sends armed agents of the State after misplaced property absolutely needs to face serious criminal consequences when it does so due to Grey’s Law levels of incompetence.

A man is suing an Orange County car dealership after they provided him a loaner car, then reported that car stolen, leading to his apprehension at gunpoint in Laguna Niguel.

Jamie Rodgers was driving on the 73 Freeway in June 2021 when he was pulled over and held at gunpoint by about a dozen law enforcement officers armed with rifles and pistols, as reported by the Orange County Register.

“I’m thinking I’m going to get shot. I’m a Black man being pulled over in Orange County. … I’ve heard too many stories of this happening,” Rodgers told the Register. “I’m thinking, I’m going to be next.”

Officers were looking for a reported stolen vehicle and believed that Rodgers was armed and dangerous, but it turned out that Car Pros Kia Huntington Beach, which was working on Rodgers’ vehicle, misplaced the loaner contract.

“Apparently, it had fallen behind a file cabinet,” the Register reported. “The dealer received a bill for unpaid tolls, couldn’t find the contract and assumed it must have been stolen, Rodgers said.”

Where was the computer in all of this? Couldn’t find the contract? I can get Best Buy to print out any receipt of any purchase I have made at their company. I can go on Amazon and find my first purchase on there. Firestone prints out the results of their work as a convenience, though I now choose to get them through email.

I’m home from Seder with friends. While it was going on I was realizing this was the last Seder I’m participating in while I’m still working. Realizing that I’m coming up to another milestone in my life—10 weeks from today will be the first day of my retirement from the agency after 46 years.

I got my retirement estimate and note that I will have to tighten my belt a bit when it comes to expenses. After taxes and health insurance & Medicare deductions my income will be 2/3 of what it currently is. But I’ll get by.

Part of me is starting to get the jitters about retiring but on the other hand I’m not gonna be dealing with work stress. I got a feeling that will balance out…

Maybe. It’s being presented as a push for hybrid, with professors being encouraged to create remote options. I’d say that’s a very good development that addresses safety concerns and could help divert further escalatory incidents. Might be the first smart move they’ve made.

I also can’t help but note these options should have been mandated from the beginning due to COVID but weren’t due to pathological normalcy seeking, which is weirdly relevant in that all these institutional overreactions are really about residual rage over the Summer of 2020.

He knows that the aid vote has doomed Putin, and when Putin goes down, the “conspiratorial extremists” go down with him. He also knows that it might happen before the election. ‘LLM In A Flash: Efficient Large Language Model Inference With Limited Memory’ (Pdf)

One of the reasons I feel like Apple is going to make some big strides in ML models on the iPhone. Google is already talking aboput having to increase ram resident on their phones in order to deal with ML models. Apple usually has less RAM so peopl have been worried about how Apple will accomdate ML models.

This papere from Apple seems to give a hint. By having resident RAm working in close concert with modelparameters on the flash memory.

These methods collectively enable running models up to twice the size of the available DRAM, with a 4-5× and 20-25× increase in inference speed compared to naive loading approaches in CPU and GPU, respectively. Our integration of sparsity awareness, context-adaptive loading, and a hardware-oriented design paves the way for effective inference of LLMs on devices with limited memory.

SO, not only can they get away with less memory but also see a huge increase in speed. Nice.

Future Tesla FSD Will Merge and Expand with XAI Grok

Am I just an old fart yelling at kids on my lawn or does this seem like a bad idea?

Oh, on another note, I discovered today that my iPhone seems to use some sort of simple learning to remember when and where I go places. My wife and I have been having a lunch date each Monday at the same restaurant. When we got in the car today, and Carplay came up, the map immediately showed me the best route to the restaurant and the time to get there.

I had not programmed it to do this nor ever even asked Maps for directions there. The iPhone, on its own, remembered the activity from week to week, realized I did the same thing a few times at roughly the same time.

I do not know how long it has been able to do this but it made the iPhone seem much smarter than IO was expecting ;-)

Ladies and gentlemen, Lizards of all ages, I present to you the folks over at the Alternative für Deutschland (AfD) 😄

German police have arrested an employee of an Alternative für Deutschland politician in Dresden on suspicion of espionage for China, the broadcasters ARD, RBB and SWR have reported.

The employee, named as Jian G, worked as an assistant for the AfD’s top candidate in the European parliament elections, Maximilian Krah, and lived in Brussels as well as Dresden, the broadcasters report.

Investigators suspect he passed on information on parliamentary operations to China’s ministry of state security (MSS), with a particular focus on Chinese opposition members, according to the reports.

The AfD was not immediately available for comment.

The suspect was arrested on Monday night, hours after three German nationals were arrested on suspicion of working with MSS to hand over technology that could be used for military purposes.

GRM is a Christian ministry that requires all residents to work for them without pay for “six hours a day, six days a week in exchange for a bunk for 30 days.” They also cannot look for outside work during that month. That’s not all though. They must also attend church every Sunday (from a pre-approved list); Unitarian services are not acceptable. And they have to attend a chapel service twice a day. And they can’t smoke or drink. And they can’t have sex during their stay.

What if you’re disabled or have medical or mental health problems that prevent you from attending church? What if you aren’t Christian? What if you just don’t want to participate in the religious activities? Too bad. You can’t stay at their shelter.

We know how the six Holy Rollers on the corrupted court will rule.

The 1802 was routinely used on spacecraft/satellites due to it being CMOS and static, in addition to having a built-in DMA controller. The most fascinating thing was that it was designed by only one person (Joe Weisbecker).

RCA sold many devices based on it - the Studio 2 game console and many microcomputer platforms called COSMAC.

re: #159 No Malarkey!

Whenever you are dealing with a software issue, think about this: from 15 billion miles away, NASA engineers were able to figure out that a 46 year old computer chip on Voyager One had been corrupted, and successfully recoded Voyager’s computer system to bypass that chip, enabling it to start resending useable data to NASA again. I am constantly amazed at what NASA is able to achieve with half century old technology.

In the engineering trade, there are a couple phrases that address out-of-date technology and its care and feeding. The first is “technical debt” which is applied as your design ages, growing increasingly further behind modern tech. The second phrase addresses having to support this aging, far out-of-date tech. This practice is referred to as “being chained to a corpse”.

In NASA’s world, not only do both apply to their spacecraft, they revel in the successful practice of overcoming them.

rando:

this is not going to play well with women in this country if SCOTUS rules that women can’t receive emergency care for complications from pregnancy. it’s emergency care at the discretion of the medial team.

How disconnected from reality are you when you think homeless people can get a home any time they want to?

That’s a logical extension from the average American’s understanding that if you work hard you’ll be compensated.

It’s not that everyone condemning the unhoused are wingnuts, it’s that American culture has a series of base assumptions about how the world works, and one of the big ones is that there’s a moral and meritocratic quality to earning money such that if you’re struggling to make money so much that you have to use a support system you’re a bad person.

Homelessness has to be explained in ways that circumvent systemic analysis: this cannot represent a failure of the status quo*, it can only be an individual-centered anomaly, and thus criminalization—punishing the quality of being unhoused because it arises from other defects of personhood—is acceptable. America’s has a lot of zones of unpersonhood before you ever get to wingnuts that actively want to police caste distinctions, and the ones that involve uncritically-held ideas about the meaning of work and money are the ones that the most Americans will sign on for, or at least banally accept.

“Welfare queen” worked because it hit upon a deeply-held Amercian fear that somewhere, someone was getting something they don’t deserve.

*and somewhere in here you get into how the US primarily creates rules and mores to protect private property owners, which is why the “solution” to homelessness is making public spaces more hostile in general. Strategies to disincentivize existing as an unhoused person also wound anyone dependent on public spaces and facilities, but those people matter less than folks with houses and cars.

Let’s not kid ourselves.his family already has knives, bayonets, morning stars and nailed clubs prepared for their own internal nuclear war once he finally kicks the bucket and it’s time to divvy up the ill-gotten gains.

Assuming bankruptcy courts and massive liens against the vulgar dump properties he technically “owns” make it to the family, it will be all-out battle between some of the most noxious, arrogant and self-entitled assholes to ever exist in this country. I hope it all comes out in the press as well.

re: #252 The Ghost of a Flea

After my husband died, I was on food stamps until I got a job. When I told two of my friends this, separately, they each told me what their fathers would think of that. It was polite of them to externalize like that.

Russian state TV has found itself a fur-clad, ‘demonstratively heterosexual’ GOP ‘beauty’ to fawn over: Marjorie Taylor Greene

The GOP congresswoman was painted in glowing terms during a broadcast on Russian state television on Sunday.

“Marjorie Taylor Greene, you’ve just shown is a beauty. She is one of a few members of the US Congress who is trying to look like a person in an old-fashioned sense of the word,” Margarita Simonyan, the editor-in-chief of Russian state-controlled broadcaster RT, said of Greene.

“She is a blonde, who wears white coats with a fur collar. She is demonstratively heterosexual,” Simonyan continued.

We loved that show. Damn shame it only had a couple of seasons.

My theory is that the critics, who seem to hate Aaron Sorkin, killed it dead. A few snotty examples:

Ever since its creation The Newsroom has served as screenwriter Aaron Sorkin’s bully pulpit… and Sorkin gets to tell us how he thinks these events should have been covered. Yes, a man who has been living cosily on a Hollywood salary for several decades and has no actual journalistic experience, gets to play fantasy newsroom and tell us all how it should be done.

The problem is Sorkin also happens to be an unabashedly left-wing writer who doesn’t seem to credit anyone on the other side of the aisle with an intelligence to match his own.

Ultimately, no one appears more deluded than Sorkin. His Will McAvoy is an insufferable blowhard, but the show spends most of its energy trying to convince us he’s a saint.

It’s hard not to check out after 10 minutes: Once Will’s big speech shifts from effectively puncturing the myth of American exceptionalism to absurd generational resentment, Sorkin’s soapboxing becomes intolerable.

And from the Wall Street Journal, saying the quiet “We hate Aaron Sorkin” out loud:

ironically this was on electoral-vote.com last week
(it’s why we started watching)

J.G. in Farmington, CT, writes: I’m sorry, I have to contest the assertion that the monologue from The Newsroom is great. I’ve seen a lot of Aaron Sorkin writing over the years, and if left unsupervised, he’s a one-trick pony. The best script he ever wrote was one where three other writers had to doctor the hell out of it (Moneyball, itself based on a somewhat false premise, considering a big part of the A’s success during that period was due to pitching). The worst? Probably Jobs or the third season of The West Wing, where his utter disrespect for women really surfaced.

Want to write a Sorkin dialogue? Here goes:

Character 1: I’d like Character 2 to do or say something so straw-man objectionable the audience will recoil.

Character 2: I see, you’d like me to do or say this outlandish thing, paraphrased so I’m not repeating your words. Then, I’ll do another fantastic thing, from a well-known piece of literature or television, to paint how ridiculous the first thing is.

Character 1 (looks down, sighs, grunts, or otherwise nonverbally objects to the conversation going this way): Character 2’s name…

Character 2, rudely interrupting: Let me assault you with statistics that no human being could have possibly memorized to illustrate why I reject your premise. And before I forget, let me liberally pepper my words with casual misogyny. Decisions are made by those who show up, including and especially those who expect opponents to change their behavior on the basis of a stern talking-to by their opponent, because that’s how politics works. Fix it. Fix it now.
Later, during an interview where a fawning host asks me how I write such witty men (not women; women exist as foils): “My allegiance isn’t to the truth. It’s to captivate you for as long as I’ve asked for your attention.”

I’d like one Emmy, please.

Republican Arizona Senate candidate Kari Lake in an interview with an Idaho media outlet expressed disappointment that her state’s 1864 law banning nearly all abortions is not being enforced, backtracking on comments she made earlier this month when she said the resurrected measure went too far.

“The Arizona Supreme Court said this is the law of Arizona. But unfortunately, the people running our state have said we’re not going to enforce it,” Lake said in a video interview with the Idaho Dispatch on Saturday.
