The Rube-Goldberg-esque machinery of the ACA is becoming its undoing.

If taxes can not be raised via the mandate, the revenues to pay for the subsidized insurance have to come from somewhere.

The primary funding sources for Obamacare come from higher taxes on the wealthy and some other taxes. The mandate wasn’t designed primarily to raise revenue, which it doesn’t provide much of, but to give people an incentive to purchase insurance. As I pointed out here, even if lots of young people decide not to buy insurance, it will only have a small impact on insurance premiums. And since lots of young people will be able to get very inexpensive policies thanks to the subsidies, I think the threat of the mandate won’t be nearly as important a part of getting people enrolled as the benefits of insurance will be.
