Supreme Court to Amazon Workers: No Extra Pay for Time Spent on Security Checks
This seems to me to be a sad misinterpretation of portal to portal laws; without the security checks the employer, Amazon by way of “Integrity Staffing Solutions” is benefiting as is Integrity staffing solutions. Overall productivity is increased due to the the stop loss preventative measures of the security checks at end of shift, without the checks it’s rather obvious that more materials would be needed by whatever percent of loss these checks stop, which would in turn increase production costs and lower overall productivity.
I’m not a lawyer however, so someone jump in and correct me here if I’m misunderstanding something?
Workers, who are required to undergo a security check to ensure they are not stealing the company’s goods, are not entitled to compensation for that extra time spent at the end of their shift. That is according to a ruling issued by the top court of the United States.
In a unanimous 9-0 decision handed down by the Supreme Court on Dec. 9, Integrity Staffing Solutions, a temp agency filling orders for Amazon, is not required to pay employees overtime pay for going through a screening process at the end of their shift. Employees say the entire screening takes up nearly half an hour after their shifts, adding a total of two-and-a-half hours every week taken up by their work duties.
The high court overturned the decision of the Court of Appeals for the Ninth Circuit, which ruled that workers must receive compensation because the screenings benefited the company. Therefore, the security checks are an “integral and indispensable” part of their jobs that the employer must compensate for.
