It isn’t. Basically, the prosecution and/or defence has to ask for a Section 7 investigation to determine whether the person was and/or is criminally insane, which may affect what kind of sentence (s)he gets. The harshest is “forensic psychiatric care with special release procedure”. It’s difficult to get declared criminally insane, it’s more likely that the a certifiable individual gets sentenced to prison than to forensic psychiatric care.
There’s a definite need for such a process, and they have to call it something. The word ‘forensic’ added to anything will get a reaction from me. I wanted to be a forensic bike mechanic. I admire forensic accountants.
