Yes, I know that Trump’s “immunity defense” is bullshit, and based mainly on his own megalomania, with little/no regard for actual law - BUT: given that the current SCOTUS is beholden to its (biased, partisan, ideologue) Asshole Bloc, the downside here (AFAICT) is that said Bloc*
might issue a one-off Opinion (a la Bush v. Gore), ruling that Donald Trump was/is legally immune for any and all actions taken while President, which would have the effect (again, AFAICT) of immediately killing Smith’s case(s). And handing The Orange Anus an unambiguous “victory”/”exoneration”. Does. Not. Make. Sense.
