The backpeddling here would be that New York is within the 100-mile area of the borders that Customs is allowed to search people. The ACLU has a map that shows the area in question.

Just noted to my wife that I am quite prepared to go to jail if someone were to order me to cough up ID or other illegal things - but I neither fly on US flights (I drive to Canada first and fly from there) nor do I live within a hundred miles of the borders or coasts (well, I live on the Inland Coast but that’s different).

I live near a border and have traveled frequently out of DTW both on domestic and international flights, and I have never been asked for ID to deplane.
