A judge undercut key arguments in Fox News’s defense against a $1.6 billion defamation suit Friday, ruling the network cannot dispute that it aired false, harmful statements about an election-technology company when the case goes to trial next month.

The decision by Delaware Superior Court Judge Eric M. Davis to reject requests from Fox News and parent company Fox Corporation to dismiss the case had been widely anticipated.

But legal experts said the specific ruling was a blow for Fox — and an encouraging sign going into trial for Dominion Voting Systems, which argues that Fox unfairly smeared it with wild allegations about its role in the 2020 election.

“This is a disastrous decision for Fox,” said Jonathan Peters, a media law professor at the University of Georgia. “The case isn’t over, no, with the trial on the way and the likelihood of appeals, but going forward I’d much rather have Dominion’s arguments.”

My dad was born there. My granddad was a farm manager for universities and other entities in his 20s. They started at UMichigan, went to Normal (not sure if it was ISU), then to Urbana-Champaign—first to work on the Allerton farms then for the university as an ag extension “professor” for the rest of his career*. When my grandmom was in her 20s she often had to feed up to 15 or 20 farm hands as part of her husband’s job.

*My grandmother’s sister had 9 kids and most of them went to the University of Illinois and lived with my dad and my grandparents during the depression and WWII. As a result, we’re still a pretty tight extended family with regular family reunions and a family scholarship fund.

In olden days when the St Lawrence would freeze in the winter and they’d shut down use of the Seaway due to the ice people would drive across the ice within the reservation instead of using the highway and bridges.

The Biden administration told a Texas federal court Friday that it plans to appeal an order by a judge that invalidates the Affordable Care Act’s promise of free preventive health services to every American with private health insurance.

The one-paragraph filing by the Justice Department says the defendants in the case, including Health and Human Services Secretary Xavier Becerra, intend to appeal to the U.S. Court of Appeals for the 5th Circuit, a conservative circuit based in New Orleans.

The notice came a day after U.S. District Judge Reed O’Connor issued an order that immediately invalidates nationwide the ACA’s guarantee of preventive services — including cancer screening and medicines to prevent HIV or heart disease. O’Connor is the judge who, in 2018, ruled the entire ACA unconstitutional in a case that reached the Supreme Court, which preserved the law for the third time in a decade.

I read the Dominion summary judgment decision from the Delaware court. Dominion won summary judgment on 3 of the 4 elements of defamation: Falsity (the Fucker Carlson defense did not work this time!), of or concerning Dominion, and publication. Most importantly, they won summary judgment that the statements constituted defamation per se, which means that Dominion does not need to prove monetary damages to prove liability; if Faux News is found to have acted with actual malice, that’s it. Dominion owns the whole kit and kaboodle.

I did hear about that. Dude that was upside down was on a snowboard. Easier to spot than skis.

Tree wells. They can be deadly. Fatalities happen periodically at the Steamboat ski area’s Morningside section of the mountain.

I’ve been caught in a couple of tree wells, in Steamboat no less. Once I was by myself. I took off my skis and used them to get myself out, it took great effort to make that happen. The other time I was with a partner and he just handed me his pole end and pulled me out that way. I’ve done the same for a few fellow skiers/snowboarders.

Skiing/snowboarding is dangerous with plenty of hazards that can kill you.

I saw a different story this week about a 15 YO, last child on a Japanese island where fishing is the main employment. To go to high school, she will have to go to a town or city off the island and probably have to board at the school. This is not completely unusual, is my understanding.

My last winter in Steamboat (2007-2008) four dudes went that way at the ski area in one season. It was unprecedented. I knew a ski patrol dude who helped extricate a body out of a tree well. Took eight dudes, the deceased weighed over 300 lbs. They used ropes and pulleys…
