Supreme Court Roulette: Michigan Court Says Trump Can Stay on Ballot

Law • Views: 13,358

The United States doesn’t have the rule of law, clearly. Each state’s Supreme Court will rule on this issue favorably for Trump if they’re dominated by Republicans, because the GOP is the party of dictatorship now.

The Michigan Supreme Court has rejected an appeal seeking to keep former President Trump off the state’s 2024 ballot.

Hm. Not much into gambling. Maybe I should change my tune to support the tribes….

I don’t gamble either. But when I’m up there, I shop on the Rez, buy gas on the Rez, etc. Every penny helps them. I remember some native kids I played with when I was gah 8? 10? I hope they have had a good life. I played with the game of life with it set on “EASY” mode as a white male. My son is on “Medium” (Asian but still male) and I still worry for him. Native? Hard & Harder…

Just a reminder that the corrupted Supreme Court heard a case calling for the abolition of Administrative Law Judges which is a goal of the Federalist Society so if Leonard Leo gets his way that fired Starbucks worker would have to go to court and wait years for her lawsuit to go thru the corrupted courts.

NBC Montana obtained court documents overnight that cite Pierce B Brosnan for foot travel in a thermal area of Yellowstone National Park, in the Yellowstone Canyon area.

Official documents that were filed yesterday by the District of Wyoming list a violation of closures and use limits at Mammoth Terraces.

Back in the 80’s when I was first in the National Guard we were getting called up to enforce their rights to spear fish under their treaties with the US government. But soldiers were allowed to “OPT OUT” of being part of that enforcement action. This was probably a good thing. The rest of us actually didn’t have to worry about traitors in our midst… 😱

A lot of people got angry with each other then. There are still people upset over it several decades later.

Proud Boy member fakes drug overdose to delay sentencing for Jan. 6: Department of Justice

A member of the Florida Proud Boys organization faked an opioid drug overdose to delay his sentencing for crimes related to the Jan. 6 attack on the U.S. Capitol, the Department of Justice revealed this week.

In a supplemental sentencing memo filed on Tuesday, the federal government explained how Christopher Worrell fled after being convicted of seven felonies, including the assault of officers with a dangerous weapon and obstructing Congress.

“The defendant, Christopher Worrell, fled supervision prior to sentencing, triggering a manhunt,” the filing explained. “He apparently had no intention of ever turning himself in.”

“Worrell was recaptured, however, when he attempted to covertly return to his residence,” the filing continued. “Worrell then faked a drug overdose prior to his arrest, and maintained that lie during a five-day hospital stay, wasting the time and money of both medical staff and the Collier County Sheriff’s Office, which provided deputies to watch Worrell 24/7 in a non-secure hospital location and was left to foot the bill for Worrell’s unnecessary medical care.”

Evidence provided by prosecutors suggested Worrell admitted to faking the overdose. The Proud Boy member was also accused of removing his GPS ankle monitor in a Walmart parking lot.

In the filing, the government asked the court to increase Worrell’s sentence.

“The government recommends that this Court increase Worrell’s sentence to account for his absconding prior to sentencing and his faked overdose upon arrest,” the document concluded.

Prosecutors previously asked U.S. District Judge Royce Lamberth, a Ronald Reagan appointee, to sentence Worrell to 168 months in prison. He could face a maximum of 20 years.

You know what, fellow Lizards? I’m starting to think this Trump guy is a real jerk. 😄

His former aide has been making bank off his name for years and he wants his cut, right now. At least that’s how former President Donald Trump sees it.

“It’s my fucking money!” the 2024 Republican presidential frontrunner privately vented in October, referring to an alleged sum in the tens of millions of dollars, a source with direct knowledge of the matter tells Rolling Stone.

Trump wasn’t talking about a business deal. Rather, he’s been grumbling about money donated to a think tank his former staffers and allies founded in 2021 to “advance the America First agenda.”

For several months now, according to three people with knowledge of the situation, the former president has complained to an array of confidants and Republicans about the millions raised by the America First Policy Institute, a MAGAfied think tank launched near the start of his post-presidency. The nonprofit is populated by several former high-ranking Trump administration officials, including Larry Kudlow, Rick Perry, and Linda McMahon, and it’s led by Brooke Rollins, who served as a top White House domestic policy aide to Trump. AFPI is one of several Trump-aligned organizations and think tanks working to craft an intellectual framework for hardline policies, ranging from voter crackdowns to potentially invading Mexico.

Therefore if SCOTUS affirms the Colorado Supreme Court, Trump can be removed from the Michigan general election ballot, and such a ruling would likely result in him being removed from the ballots of enough swing states to make a legitimate victory impossible. This could give the GOP sufficient grounds to locate a spine and select a different nominee for President. However, at least one Trump appointed Justice would have to vote to affirm Colorado, which seems unlikely. Still, it’s worth a shot, because Trump will attempt to seize power by any means necessary if he is the GOP nominee, and lots of Republican officials will help him.

Some time ago? Not quite 3 months ago. Humans, especially Americans, have the memory of a flea — except when they hold centuries old grudges. We started the forever wars in response to 9/11 — our attack on Iraq was really an unjustified extension of the war against Afghanistan.

I detest Netanyahu and the strategy he is following, and favor an immediate cessation to the current hostilities but Hamas and its allies pose a real threat to the survival of Israel. Afghanistan did not launch missiles on a daily basis against our nation after the 9/11 attacks.

I’ve been trying to get across a very salient concept the past few days. When we point out an evil at LGF it does not diminish any other evils.

When it comes to the Israel - Hamas war we do not have to tit for tat compare or “wuddabout” as the red hats do to discuss what’s wrong. It’s not a contest to see who has the bigger evil - we must pay attention to the suffering, and do our best to diminish it. Right now this is all outside our control here … We all know what’s wrong because past all the anger and hurt we are still human.

This morning I saw a mass grave being filled on the Today show, it wasn’t what I wanted to wake to, and I don’t think it was what anyone ever wants to wake to.

How about Hamas returns the hostages & the remains of the ones that they killed. Why don’t the people who are demanding a unilateral ceasefire mention the hostages once in a while? I am sure Israel gets their citizens (also some US citizens being held as well as other foreign nationals) they will immediately cease fire.

Hamas is still holding these “evil settler colonialist apartheiding genocidal subhumans” not as though anyone cares or anything.

A silver lining to Dobbs is that it has accelerated access to telemedicine prescription of abortion pills by mail, even in states which have banned abortion, thanks in part to shield laws passed in some blue states to protect abortion providers from prosecution in red states. This would be threatened by the election of a Republican President who would stock his administration with forced birthers, and would likely invoke the Comstock Act to ban abortion nationwide.

They are only being asked to ban mifepristone. I don’t think they will, but even if they do, misoprostol only abortions, which are slightly less effective than the two pill regimen, will continue, and women will still be able to get mifepristone from overseas.

Yes. and also remember that mifepristone is also used for several health concerns, like fibroids and Cushing syndrome. Likely they will not ban it totally but remove the recent FDA decisions that made it easier to get - ie through telemedicine, send through mail, etc. So women will have to go see a doctor.

Fox sure loves to beat the racist and misogynistic drums…

Fox News Melts Down—AGAIN—Over Kamala Harris’ Gas Stove

thedailybeast.com

The conservative cable giant reheated some leftover outrage about the vice president’s kitchen appliances, serving up a month-old helping of culture war grievances.

What are we outraged about now, folks?

Well, if you are Fox News, it’s deeply upsetting that Vice President Kamala Harris once again posted a photo of her gas stove on social media.

Why is this so outrageous? According to the right-wing outrage-industrial complex, it’s because the Biden administration supposedly wants to take away everyone’s gas appliances, so therefore, Harris is a raging hypocrite.

Over the holiday weekend, Harris shared an image of her and her husband Doug Emhoff making Christmas dinner. The largely innocuous pic featured the smiling couple in the kitchen, apparently making Beef Wellington. “Merry Christmas to all. May your day be filled with love, family, and good food,” Harris wrote in the Dec. 25 tweet.

Early morning show Fox & Friends First kicked off things for the conservative cable giant on Wednesday, comparing the Thanksgiving and Christmas photos before wondering if Harris’ team is “not telling her about the backlash or do they not care.”

“They just don’t care,” Washington Examiner deputy editor Kaylee McGhee White declared. “They want to deny you what they want for themselves. We saw it during COVID, the hypocritical double standard, where the leaders were operating by a completely different quality of life than they forced on everyone else.”

During the network’s morning flagship show Fox & Friends, guest host Griff Jenkins wailed that he was “legitimately worried that they’re going to come for the gas stove” before getting even more conspiratorial.

Yes. and also remember that mifepristone is also used for several health concerns, like fibroids and Cushing syndrome. Likely they will not ban it totally but remove the recent FDA decisions that made it easier to get - ie through telemedicine, send through mail, etc. So women will have to go see a doctor.

I don’t think they will even do that. If they open the can of worms of allowing doctors to sue to challenge FDA decisions based on hypothetical future harms to doctors, they will throw the entire pharmaceutical industry into total chaos, and it would be very unlike Roberts to cause titans of industry that much indigestion. I think they will reverse the 5th Circuit in a 7-2 decision.

Unless your relatives are Supreme Court Justices, I seriously doubt it. At the very least, Roberts will corral Kavanaugh to reverse the 5th Circuit. The only sure votes to restrict mifepristone are Alito and Thomas.

They start with a lie: No one ever suggested we take away gas stoves. What was suggested is that installations of gas stoves should include ventilation. You have to be pretty dumb to be against adequate ventilation, so Fox lies to their viewers and turns it into something it’s not. They know, explicitly, that they are lying. They don’t care. Then they bring on the guests to opine about the lie and accuse VP Harris of being a hypocrite for having a gas stove with adequate ventilation. The stupid burns.

Kinzinger goes after radical Xtians

alternet.org

In response to former President Donald Trump’s bizarre Christmas Day rant in which he openly hoped his political opponents would “rot in hell,” a retired Republican congressman called on evangelical Christians to reconsider their support of the ex-president.

Former Rep. Adam Kinzinger (R-Illinois), who was one of the two Republican members of the House Select Committee on the January 6 Attack, seized on Trump’s Truth Social post to make the argument that pro-Trump Christians couldn’t choose to follow both Jesus and the former president.

“I’m going to go out on a NOT limb here: this man is not a Christian. If you are a Christian who supports him you don’t understand your own religion,” Kinzinger posted to X (formerly Twitter). “Trump is weak, meager, smelly, victim-ey, belly-achey, but he ain’t a Christian and he’s not ‘Gods man.’”

Kinzinger, who himself is a member of the Baptist Church, is joining a growing chorus of evangelicals who are calling on their fellow Christians to reject Trump. On Christmas Day, author and journalist Tim Alberta wrote that the looming threat of Christian nationalism — in which adherents of far-right ideologies want to seize the levers of power to institute a Christianity-based hierarchy in society — was too grave to be opposed by Christian believers alone.

“It is incumbent upon [evangelicals] to stand up to this extremism in the Church,” Alberta — the son of a megachurch pastor who identified as an evangelical since childhood — wrote in The Atlantic. “Yet the responsibility is not theirs alone. No matter your personal belief system, the reality is, we have no viable path forward as a pluralistic society — none — without confronting the deterioration of the evangelical movement and repairing the relationship between Christians and the broader culture.”

In a November interview with Baptist News promoting his new book Renegade: Defending democracy and liberty in our divided country, Kinzinger said both his political party and his faith had been “hijacked by extremists who represent a real danger to our democracy.”

“The devil’s greatest trick has been to convince my fellow Christians to basically destroy their own reputations,” Kinzinger said.

I’ve been thinking about the Michigan Supreme Court decision and there has been something that has been bugging me… I saw something saying that they concluded that Michigan law doesn’t require a candidate for office to affirm their qualifications for office and that has me wondering what would happen if Obama or GW Bush or Arnold or Taylor Swift tried to run for president despite being ineligible.

89
KGxvi  Dec 27, 2023 • 2:45:48pm

this seems like good news:

Judge B. Lynn Winmill ruled Wednesday that the American Civil Liberties Union (ACLU) was right to ask for an injunction blocking the law until its lawsuit on behalf of two Idaho families impacted by the ban is decided, saying it had “shown a strong likelihood of success” in proving the state had violated the 14th Amendment’s guarantee of equal protection under the law.

as a general rule, if you’re the defendant in a case and lose on a preliminary injunction, you should be prepared to lose the case in chief.

They don’t believe in local control — only control where their party is in power. Whenever there is a conflict, they will go with the party that represents their interest at whatever level that party is in charge.

Por ejemplo, as Rachel would say…

New York State massively botched its rollout of new rest areas along the Thruway. They awarded a contract to a for-profit Irish company, Applegreen, which is building these awful cramped rest areas with tiny bathrooms and getting deservedly roasted for how horrid they are.

And they awarded concession contracts to new fast-food outlets, including Chick-Fil-A, which of course isn’t open on Sundays - and so if you go to a lot of these rest areas on a Sunday, half the place isn’t open and the other half is even more overcrowded.

So there’s a legislative effort underway now to revise the laws governing the rest areas so that future contracts will require any restaurant to be open seven days a week. If CFA doesn’t want to bid on those contracts, that’s CFA’s problem. And if CFA wants to open anywhere else, it will still be able to.

New York State lawmakers doing the bidding of New York State residents to make things better in New York State… which is why noted state’s rights advocate Lindsay Graham is, of course, upholding the rights of New York State lawmakers to…

(touches earpiece)

Oh, never mind.

If the Rs want to run a guy in their primary in Michigan who could get booted later in the process because he’s ineligible for the office, I’m all for it.

the Colorado case is different because the law there addresses the primary specifically. You can’t run in a primary there if you’re ineligible for the office.

Michigan doesn’t have that.

Obama ran without that experience; there’s a lot he accomplished but he would have been far more successful if he had more experience. In one sense, he was similar to Trump: he wasn’t exactly a cult leader but he had a devout fan base who supported him enthusiastically and overlooked any flaws. OTOH, none were so devout that they would continue to support him if he had shot someone on 5th Avenue.

Unlike Trump, when Obama’s performance in initial debates for the 2008 primaries was less than stellar, he learned and improved dramatically. But we know now that it doesn’t matter who technically wins debates in the current climate, it’s who has the brain-dead loyal voters locked up, voters who literally don’t care whether a candidate lies or is totally ignorant of issues. They are wed to the Trump cult. But they also support lies pushed by the GOP on a whole range of issues. Unless Trump loses, and Democrats surge nationwide in House and Senate races, the future of our nation is bleak.

“Devout” until almost halfway through his first term; they abandoned him pretty damn quickly when they didn’t get their pony. That’s why the 2010 midterms went the way they did, and why he couldn’t get a whole lot done after that.

JAC Motors, a Volkswagen-backed Chinese automaker, is set to launch the first mass-produced electric vehicle (EV) with a sodium-ion battery through its new Yiwei brand. Although sodium-ion battery tech has a lower density (and is less mature) than lithium-ion, its lower costs, more abundant supplies and superior cold-weather performance could help accelerate mass EV adoption. CarNewsChina reports that the JAC Yiwei EV hatchback deliveries will begin in January.

Yiwei is a new brand in 2023 for JAC. Volkswagen has a 75 percent stake in (and management control of) JAC and owns 50 percent of JAC’s parent company, Anhui Jianghuai Automobile Group Holdings (JAG). The Chinese government owns the other half of JAG, making for one of the auto industry’s stranger pairings.

The numbers from The Fine Article suggest that the sodium-ion batteries being deployed are about 75% of the weight-capacity figure of modern lithium-ion batteries so a similar-sized battery pack will give 75% of the range of the better Li-ion tech.

Well, golly, Mr. Secretary. Hamas, like it or not they are the elected Government of Gaza and backed by the Israeli Conservative Government at the time of their election. They decided to attack their perceived enemy, Bibi’s Government, by attacking the Israeli Citizen’s who elected Bibi’s Government because they have inadequate weapons systems that could attack the IDF directly. You attack the perceived enemy with what you’ve got rather than the weapons you wish you had.

One of the biggest reasons this happened was that Bibi moved forces defending the Settlements immediately around Gaza to enforce the taking of Palestinian lands in the West Bank and defend new settlers moving into this stolen land. It was perceived by Hamas as the slow Transfer of emptying Judea and Samara of Palestinians once and for all.

This is documented fact, not agitprop.

Everyone in the Governments involved in this conflict since October 7th needs to be shipped off to Brussels, tried, convicted, and sentenced to be imprisoned for life, both Hamas’s and Bibi’s. (Note I did not say Palestinians and Israelis. They didn’t authorize the killings. They are all victims of their stupid murderous governments. They were, and remain INNOCENT CIVILIANS [capitalized for emphasis].)

Maybe that will finally get these monster’s attention, on all sides.

I hope that improves, but until then, the numbers will be closer in cold places where lithium doesn’t work well. Articles on EV batteries in the cold say battery output can drop 40% at 22F/-5C. Some articles say that’s a drop in battery output, others say a drop in range, which is also impacted by cabin heaters in the winter. I don’t know what the real numbers are, but sodium may be a good option where it’s cold much of the year.

On average, HERE estimates that vehicle range drops 20% when temperatures start hitting the 32 degrees Fahrenheit mark. If it drops another 10 degrees Fahrenheit that number slumps to 40%.

The density of sodium batteries is still relatively low, between 140 Wh/Kg and 160 Wh/kg, compared to lithium-ion battery’s 180 Wh/Kg-250 Wh/Kg.

flashbattery.tech

This is for people who can’t afford LI, or live somewhere very cold. It’s less dense and lasts fewer charge cycles, but it’s much less expensive.

re: #47 Hecuba’s daughter

But such a sudden deterioration in performance? Or maybe it finally reached a breaking point — like pouring water into a glass and it seems fine until it overflows. And that’s what’s happening now.

Yeah, sudden deterioration in performance are possible. And I don’t know if/how the user database is connected to the message database.

Things I ask about when a database issue is presented:
1) Do you have indexes?
2) Do you have more tables that could use an index?
3) Has your database been tuned recently?
4) What space is available for your database and its swap files?
5) Has there been an increase in the number of users on the database (e.g., a new application is now pulling data)?
6) What kind of searches are you allowing on your database? I doubt Charles is allowing the database version of *.* (in other words, pull everything), but there could be searches that shouldn’t be allowed because they bog down the database.
7) Any other questions that might come out as I attempt to find out what the service level agreement is for whatever application is having problems.

/not a database expert, questions gained through years of hard experience. And then you find out it’s not a database issue but it’s microcode on one of the server CPUs.

You are a wise woman, and I respect you. I feel for you, given the situation with Z right now, but dammit, if I see one more picture of two Jewish parents with their two cute kids, who might be still be alive, when 8,000 Palestinian kids have been crushed to death and blown to bits by useful Jewish Idiots acting on Bibi’s orders, I am going to start asking questions about your biases toward non-Jewish Semites and if it reaches the level of blatant other Tribal-loathing, which is just another term for hate of The Other.
