Special Counsel Jack Smith Blasts Judge Cannon’s Jury Instruction Request in Trump Documents Case

Law • Views: 12,917

Have you noticed how Donald Trump attacks and smears judges and their families, attempting to incite his cultish followers into violence? He’s done this with every case he’s involved in — except the judge he appointed, Aileen Cannon, in his stolen classified documents case.

There’s a reason for this.

In perhaps prosecutors’ strongest rebuke yet to how Judge Aileen Cannon has handled the classified documents case against former President Donald Trump special counsel Jack Smith said in court filings late that the judge had ordered briefings based on a “fundamentally flawed” understanding of the case that has “no basis in law or fact.”

Perhaps they could avoid having one voice over two different videos of bearded people moving their lips. (I also don’t like moving chyrons.) And I hate complainers.

That somebody will probably conclude that you’re a performative asshole who has no intention of actually helping who you say you’re trying to help, and can therefore be completely ignored.

Yep, the performativity in this situation definitely isn’t the government that is still giving the IDF bombs while politely suggesting they use the bombs less, all while pretending there’s an ongoing dialogue with Netanyahu even as he just says aloud that he won’t stop.

I mean, if you can’t be polite when asking the people materially doing things to not do them, then how could your position be valid?

Not that I am overly (OK, in any way) familiar with Federal judicial processes or procedures: but just looking at it, ISTM that Judge Cannon has decided (or, more likely, that it has been decided for her) to tank the Trump documents case entirely, and that her main goal now is to dismiss it in such a way that Jack Smith can’t (as he inevitably will) appeal it over her head. Which will probably result in a major slapdown by the Circuit Court; who, likely, won’t buy the “inexperience” bullshit, either.

I’m sure that Aileen Cannon is getting serious coaching in this: she doesn’t seem a sophisticated-enough jurist to come up with crap like this on her own….

Marcy Wheeler posts about where the “legal theory” came from, but gives Cannon the excuse of being a chump, instead of a corrupt judge.

Jack Smith to Aileen Cannon:
Treating non-lawyer Tom Fitton’s theories as law will lead to mandamus.

“Not only has Trump been falsely suggesting — without evidence — that he did designate these documents personal records. He couldn’t have done so, because he didn’t know of this theory until over a year after he stole the documents.

But Cannon is such a chump that she has been chasing a theory spun up by Fitton, someone who has only an English BA.”

From the link:

Anyway, most of the fish passage [work] that’s been done in the U.S. has been done out West. So it’s very specific to salmon, trout—really strong swimmers. You’ve seen trout runs—they’re just flying through the air. We don’t have those fish. So most of the alternatives were scratched from the get-go.

Keep scratchin’. Even those ‘really strong swimmers’ were helped by nothing short of dam removal. Delay no more.

Weren’t there some Trump lawyers recently (or was it this team) who pulled some kind of similar stunt hoping it would escape the notice of the prosecution team or the judges? Think it had something to do with pretending properties were incorporated in a different state?

Here they come again.

@laurahelmuth.bsky.social
It’s the year 2024 and West Virginia just passed a law that will allow the teaching of religious alternatives to science (meaning creationism) in public schools. 🧪 scientificamerican.com… by Amanda Townley of the National Center for Science Education in Scientific American

“…On March 22 West Virginia governor Jim Justice signed a bill that purports to protect the ability of the state’s public school educators to teach scientific theories. There is no actual problem that the new law would solve, however; none of its supporters produced a teacher who plausibly claimed to have been oppressed. But the legislative history of the bill, known as Senate Bill 280, makes it clear that its real aim is to encourage educators to teach religiously motivated “alternatives” to evolution. As introduced, SB 280 would have expressly allowed the teaching of “intelligent design” in West Virginia’s public schools.”

An update to the update to the update …. on relocating:

[Embedded content]

i bought a harley in palm beach in 2001
then i moved south to broward county
local harley dealer was about 4 miles from home
i’d been a faithful customer every since.
for service, i’d ride the bike over, and run home, or vice versa.

the day that bike turned 20 years old they would no longer touch it - for anything. not an oil change, nothing.
think that was a great incentive to get me to buy a new bike?
ha!

i found smart local aftermarket guy also in town.
he took care of me for 3 more years.
he did a pretty good business on bikes harley didnt want any more

Seeing Sundar claim that Al was going to be more important than fire or electricity really helps explain what’s gone wrong at Google these days. I get no joy from saying this.

Acknowledging the difficulty of the phrase when speaking about a Jewish man, I strongly suspect this is the “come-to-Jesus” conversation Biden threatened in his supposed “hot-mic” moment at SOTU. (Which wasn’t a legitimate hot-mic moment; Biden knew exactly what he was doing.)

I’m sure that this is really going to help the next generation of West Virginia kids compete successfully in a global economy. Way to ensure your kids have a chance at a good future West Virginia. ////

Sometimes a system is failing so badly that it is worth considering whether relocating to a saner place rather than trying to survive until it somehow fixes itself. Even when fleeing for the sake of your children’s lives reduces the already slim chances of the system righting itself.

It isn’t Trump’s financial statement the court requires, it’s the financial statement of the company making the bond. You know, to make sure they can actually cover the $175 million if needs arise.

He seems to think so, or it would have been included. It would probably show that he’s not as rich as he says he is, and that’s one of the core parts of his sociopathic personality. And since it’s a criminal case he may fear the consequences of openly lying, on record.

Would be nice, but I am pretty sure the law is pretty settled on immunity and qualified immunity claims. Since it is immunity from suit it needs to be settled before the case moves forward. I don’t know if the timeliness thing somehow overrules that, but I doubt it.

The surety bond is coming from an insurance company, not Trump, so the court requires a financial statement from the insurance company showing they have the financial resources to pay it. Trump’s financial situation in this case is of no concern to the court; that’s the insurance company’s problem.

How the fuck he only got 5 years in prison.

Backstory. Warning: This avoids really graphic description but still describes some of the worst depravity I have ever heard of.
BBC: Hunting the monkey torturers

The level of abuse on YouTube, as bad as it had been, had not prepared [undercover investigator] Kapetanich for the private world of Telegram, where monkeys were known as “tree rats” and no idea for torturing them was too extreme.
Ape’s Cage contained about 400 people. The cast of characters was a mixture of the strange and — even stranger — the seemingly normal, all known to one another by their screen names. There was the Torture King, who had invited Kapetanich in; there was “Sadistic”, a gas station attendant and grandmother in rural Alabama; there was “Bones”, a former US Air Force airman from Texas with a big collection of guns; and “Champei”, who caused chaos and infighting in every group he joined. There was “Trevor”, who couldn’t contribute during daytime hours because, “no phone at work, nuclear stuff”.

And it wasn’t just Americans, there were dedicated members in Europe and Australia. Among the cruellest contributors to the group was “The Immolator”, a 35-year-old woman who loved birds and lived with her parents in the English midlands.

McCartney, the monster who was just convicted, has a swastika tattoo in addition to his pictured Trump swag.
