Its precisely because the MTA is an agent of the government that the speech it can limit is strictly proscribed. If it was a private enterprise it could tell Geller to piss off.

I dunno. As an agent of the government, it’s got to make sure that nobody is discriminated against. Virulent anti-Muslim ads could certainly have an effect like that. It’s basically an ad that says that there’s a war between Muslims and Jews and we need to take the Jewish side.

I dunno. It’s a tricky situation, where it’s hard to craft a good rule. I’d rather err on the side of letting them get shown, with the disclaimer, but I also don’t think we need to wear the police force out chasing down people who vandalize them.
