A hung jury or a dismissal.
There’s nothing preventing lawyers from being jurors, but typically lawyers don’t like lawyers on the jury. The concern, often, is that the other jurors may defer to that lawyer-juror on important issues because of their expertise. If I were a criminal defense attorney there’s no way that I’d want a district attorney on the panel.
It’s also not the profile of a person you’d want if you’re trying to get a hung jury. They’re probably going to be prone to side with the prosecutors because they are also prosecutors. And, again, a lot of ordinary folks are going to defer to them.
Also not sure how this will lead to a potential dismissal.
My guess is that they just haven’t got to the preemptory challenge portion of the proceedings.
