Weird political theory about why Breshear is pushing the appeal:

Allows Jack Conway to not have to be in charge of the appeal, therefore when Conway is on the winning side, he can use that as momentum to the next Governors race. Breshear is in the final term and he is taking one for the team.

Another theory. Andy Beshear is running for AG and half of Ky Democrats still oppose ssm. By keeping the litigation going, Andy gets to straddle the fence by saying he can’t take a position now because he might have to issue an AG’s opinion on it after he takes office if he wins.
