Video: Legal Analyst: Expect a ‘Tug of War Over Michael Cohen’ in Trump Trial Opening Statements

Law • Views: 12,533

I wish they’d stop referring to this trial as a “hush money” case, because at its heart it’s really about election interference. Stormy Daniels was paid off to suppress damaging information at a critical point in Trump’s campaign for president. The same goes for the “catch and kill” deals Trump made with David Pecker and the National Enquirer.

If he weren’t running for president, Trump would not have cared if any of this stuff became public.

Fmr. Sr. Member of Mueller Probe Andrew Weissmann and MSNBC Legal Analyst Mary McCord join The Weekend to discuss what to expect during opening statements of Trump’s hush-money trial and who the key witnesses may be.

I just watched this fascinating review of Civil War.

Its thesis? That America is LARPing itself into a civil war by participating in the kayfabe of the culture war.

The idea kinda resonates with me.

Not only was it a coverup of election interference, he wrote off the hush money payments as “legal fees” and claimed them as a business expense. That’s tax evasion on top of the other crimes.

Here’s a question for Ayman…if you don’t agree with what one 20 year old voter says about Biden and Trump being the same and that President Biden hasn’t done anything in office, then why put his words on the screen and let it sink in for a good 45 seconds?

It would seem to feed the narrative and now you have to distance yourself by saying, “But I don’t feel that way!” - no…that low information asshole is wrong and he is not representative of the majority of voters.

I understand there were two protests at Columbia. A peaceful sit-in with prayer inside the campus and then a reactionary rally for the cameras by non-Columbia attendees after they were rallied to show up by outside interests.

All of the charges are falsifying business records. Basically 3 counts per month for each month he payed Cohen. Each month there was a check, a stub, and a false invoice. One month was double billed so instead of 36 counts it is only 34.

Eclectic Cyborg  Apr 21, 2024 • 5:36:44pm

A little something I wrote earlier this afternoon:

PRECIOUS

Unassuming, in a glass case
In Mr. Colemans downtown store.
Most people see a simple ring
Nothing less and nothing more.

They don’t think about its history
Passed from parents on to kids.
They don’t understand the mystery
Or the secrets that it hid.

This diamond has survived a war,
been flung into the sea.
It’s seen sunsets in Hollywood
And the hills of Tuscany.

This stone has witnessed arguments
And tempestuous affairs.
For thirty years it sat inside a box
Behind the stairs.

It’s graced the hands of newlyweds,
Been in the possession of a thief,
Nearly lost in a game of pool,
And helped a widow through her grief.

It has graced a dirty nightstand,
Sparked a fight between two brothers
Been sold to pay for diapers
By a desperate single mother.

It may have never breathed a breath
But at times it seems alive.
Its journey, strange and wondrous
Though perhaps a bit contrived.

Now it sits, almost unnoticed
In Mr. Coleman’s store.
It’s not a simple diamond ring.
It’s a legacy and more.

Washington State Republican Party endorses Semi Bird’s gubernatorial candidacy

Read the whole thing. The Washington GOP is just crazy. Instead of picking the leading candidate, Dave Reichert, who has great name recognition in the state (both politically and as the guy who brought in the Green River Killer), they went for a MAGA nut with a criminal record. By changing the rules, ignoring the rules and generally corrupt procedures.

This probably had a lot to do with little Mikey finally doing his job. The Russians have been persecuting, arresting, beating up, and worse the evangelicals in Russia and occupied Ukraine, because they’re not Orthodox. This looks like it ended up being a monstrously stupid thing to do just for this reason, but the RU army is either too ignorant or too undisciplined (or porque no los dos) to actually stop themselves.

Is this really the reason, or just the excuse he’s giving why he changed his mind to his constituents and fellow GOPers? I’m not surprised one bit that Russia is persecuting Evangelicals like they’ve been persecuting members of all “non-traditional” religions (including members of Hare Krishna, etc.).

This is the Republicans’ problem, and why the party as a whole is not long for this world. In order to win a primary in a party that is increasingly centered on Trump, you have to be as hard right as possible. But these hard-right nutjobs are completely unelectable in a general election. The career GOP’ers - who know how the sausage is made, and want to actually win elections and gain power - know this, and are trying as hard as they can to tamp down the influx of pants-on-head crazy. Let’s not assume the party will be dying when they have all these tricks to disenfranchise those who do not share their views. ‘They want him killed’: Alan Dershowitz says Trump would be murdered in prison

Dershowitz made the remarks to (WHAT ELSE BUT) Newsmax after Rep. Bennie Thompson (D-MS) introduced a bill to revoke Secret Service benefits if the former president is convicted of a crime.

“So he would not have Secret Service if he’s behind bars,” a Newsmax host told Dershowitz.

“Well, that’s ridiculous,” the law professor replied. “That means that they want him killed, because he’s obviously a target. We live in an age where everybody is in danger.”

I think that’s part of it, too: this guy is a wet behind the ears backbencher who got post-turtled into a leadership role, and went from listening to Fox News and whackjob preachers to getting the most sensitive US intelligence from grim-faced very competent looking people.

I ask myself from time to time ‘Did skiing ruin your life?’

In a lot of ways it didn’t. In some ways it did.

Dad forbade my brother and I from getting into downhill and grand slalom. I wanted to race, but he was in no mood to watch gates on the weekends. I firmly believe he did me a favor keeping me off the course and enjoying recreational skiing…

As far as I know, he’s not giving it as an excuse at all. Johnson is stating that he believes the US intelligence and that a Russian victory would be a disaster. I think that’s part of it, too: this guy is a wet behind the ears backbencher who got post-turtled into a leadership role, and went from listening to Fox News and whackjob preachers to getting the most sensitive US intelligence from grim-faced very competent looking people.

But little Mikey is a true believer, and it would have been a lot easier to dismiss it all as the DeEp StAtE except there was his people, the evangelists, telling him that his people were getting hurt.

US intelligence = head
US evangelicals = heart

IF we want to give him the benefit of the doubt.

I just watched this fascinating review of Civil War.

Its thesis? That America is LARPing itself into a civil war by participating in the kayfabe of the culture war.

The idea kinda resonates with me.

Watched both Grizzly Man & Civil War this weekend.

I guess you could say they’re both movies about people who choose to exist in non civil cultures.

Running gates made me hate skiing. And I ran too many gates. The reason I took up snowboarding as a teenager, because I was desperate to make sliding on snow FUN AGAIN. Now I’m elite telemark. It’s been a fun odd journey… But I question myself.

Skiing made me a raging alcoholic, made me grandiose in my 20s that alienated almost everyone around me except those that knew of my weirdness (a number of people in Steamboat I can count with one hand), and thinking of skiing - I mean truly thinking of what skiing is on this planet - it’s gotdam depression inducing.

I love functional programming. It’s a lot closer to math than others. Why have a function that adds a list of numbers and another function that multiplies the numbers when you can pass in the operator to a function that computes a running total by taking the current result and the next value and applying the operator?

..

Of course all climate specialists have warned that warming surface temps mean increased extreme precipitation events.

But few people listen.

For most of the world every day is simply eat, drink and be merry for tomorrow we die.

Substantial damage that is done by a major flood is just part of life, as people will tell themselves.

Hard to feel bad for a petro-state becoming a victim of what is likely a direct result of a changing climate.

It is worth it sometimes for the live performances. Prince’s solo on “My Guitar Gently Weeps” should get its own induction.

This is supposed to be the most egregious thing you can do if you’re just some fucken golfer at ANY golf course.

Among them. Since it shows a complete lack of respect for the course* and any other golfers who might use that green later.

But it fits Trump’s M.O. completely as someone self-absorbed in his own superiority and convenience. Who probably takes great glee in flaunting any and all rules and behavioral expectations since those are for the suckers other guy. And hasn’t been held to task or responsibility for it for decades.

* - The course itself as a construction and also to anyone who spends time maintaining it. And putting greens, especially on an expensively maintained course, are very sensitive things since grass essentially doesn’t like living tightly packed in at a height of 1” or less.

That would be a funny character development by the prosecution…call a greenskeeper to the stand, discuss golf etiquette and when carts are supposed to return to the path (100 feet before the green) and what Trump’s behavior says about him and rules. Just to publicly shame him in the golf community.

I am pretty sure the golf community is already pretty aware of what a putz he is. The stories about him cheating and other abuses have been around for years and years. And I have not been golfing much for the last twenty years or so.

Mistrial is his best defensive option at this point. Jury has been set. Just need to trigger the right clusterfuck and double-jeopardy saves the day. Fox is trying to help him and a national media company has a lot of people on its staff that can investigate jurors and find or manufacture dirt on them.

A mistrial doesn’t trigger double jeopardy; he could be tried again. However, that would be after the election, serving Trump’s purpose, especially as he would trumpet a mistrial as “Total Vindication!!!”

Recall we buried the 8awg rubberized feed wire from barn to subpanel a month or so ago.

Yesterday I finished rewiring the subpanel and finally got to connect the feed wire. Went pretty fast.

The voltage drop from barn to panel went from 2 whole volts to about 7/10 of a volt. That’s a great success.

Here’s the before

and the after

A bit more professional and ‘beefy’, which accounts for some of the efficiency. Also circuit breakers make it easier to turn a pump on and off - don’t need a screwdriver any more.

We had the aerator on a low voltage disconnect (upper left of before pic), so if a shady day came around and the batteries drained, the waterfall and filters kept working longer.

That’s no longer necessary. With 4 batteries and thicker wiring and proper busses, there’s enough power to run all 3 pumps all the time. In fact we learned this a while ago when i made a mistake and the three pumps ran 6 hours on battery! We used to never get more than 30-45 minutes doing a sunny day test with the panels off. A lot of that is due to the much thicker wires on the batteries (2awg vs 12) and the distribution panel (8 vs 12), and that 2 of the solar panels don’t goof off any more.

Because the rewire went so fast, I had time to start distributing the 40 yards of mulch. Oh wait, did I say we got 20 yards? Well we did, through the free website service. Then the local guy who delivered it called me directly and asked if we could use more, so we got a second 20 yard load. We’re letting neighbors take all they need.

When there’s time (HA!) I’ll still try to write up the entire evolution of the distribution panel with pics because the progression is kind of interesting.

A quick check on your own is pull the cover off your fuse panel. Check to see if the previous homeowner wired the 12 gauge wires to 20 amp breakers, and 14 gauge wires to 15 amp breakers, and not vice-versa.

I just watched this fascinating review of Civil War.

Its thesis? That America is LARPing itself into a civil war by participating in the kayfabe of the culture war.

The idea kinda resonates with me.

Our media is basically like the audience at a mid-90s talk show (think Jerry Springer), salivating and frothing at the idea of the nation splitting into two factions and going at each other like feral animals so they can film it all. They’ve been fantasizing about it since at least the 80s. After all, what’s better than a war that they can report upon from the comfort of their own homes?

Without, of course, understanding that the logistics damage to the nation from such an internal conflict is not going to be profitable for them, or for very few people in fact.

And TV and radio stations are going to be an immediate target as well since a propaganda goal will be control or destruction of media outlets in order to attempt to control messaging.

No wonder Trump is so exercised about this. He know this all looks super bad for him, regardless of his belief in a Deep State Witch Hunt and his eventual complete exoneration*. I expect a motion to delay the trial until the appeals have all played out in these cases, so that their final disposition is known and the jury isn’t unduly prejudiced by Fake News.

* = exoneration that isn’t coming; appeals only cure errors as a matter of law or process, and the judges in those cases were very careful to follow the book to a T. Appeals courts do not have the power, generally speaking, to overturn a verdict as found by the trier of fact, unless new evidence comes to light that merits a re-trial.

She is. She genuinely believes the whole Mike Lindell bulkshit about hackable voting machines and that paper ballots, in person, are the only “secure” way to vote. She has wholly swallowed the Trump mythos that he won the Election Day vote and that all the votes that were tabulated after (never mind that many of those were actually cast in person on Election Day) were fraudulent.

No wonder Trump is so exercised about this. He know this all looks super bad for him, regardless of his belief in a Deep State Witch Hunt and his eventual complete exoneration*

We have to remember who we are dealing with here: for Donald Trump, anything other than a 100% loss rate in each and every court on each and every trial and each and every appeal is going to be spun (or try to be spun) by his campaign/PR machine as a “complete exoneration”; the same way he did with the Mueller Report.
Only this time, he has more at stake.

That Trump actually is running pretty much 0-100 in his legal battles so far is only moderately good news: he only has to win once: *we* have to run the table.

O/T

Instagram is profiting from several ads that invite people to create nonconsensual nude images with AI image generation apps, once again showing that some of the most harmful applications of AI tools are not hidden on the dark corners of the internet, but are actively promoted to users by social media companies unable or unwilling to enforce their policies about who can buy ads on their platforms.

While parent company Meta’s Ad Library, which archives ads on its platforms, who paid for them, and where and when they were posted, shows that the company has taken down several of these ads previously, many ads that explicitly invited users to create nudes and some ad buyers were up until I reached out to Meta for comment. Some of these ads were for the best known nonconsensual “undress” or “nudify” services on the internet.

One of the most egregious ads include a photograph of Kim Kardashian and the text “Undress any girl for free. Try It.” People who clicked on this ad would be taken directly to one of the biggest web-based undress apps, where they can upload a photograph of a real person and pay for the app to generate an image that makes the person in that photograph appear nude. According to Meta’s Ad Library, several versions of this ad, some featuring other women, ran on Instagram and Facebook between March 13 and 19.

Isn’t the “sufficiency” at issue not the amount of the bond, but its fundamental credibility?

From what I’ve read, and understand (very likely incorrectly), the $175M bond TFG came up with is basically secured by little more than an IOU from Trump himself, or one of his entities; and Letitia James is going to court today to try to get it “disqualified” (?).

ETA: just recalled that the issue with the Knight Specialty bond is that they (KS) couldn’t identify the specific “assets” backing it up (and still haven’t AFAIK): that it was, ultimately, a Trump “loan” was/is just widely suspected, not proven. Still VERY questionable, though.

According to the court filings the specific assets are a Charles Schwabb account with just over $175 million in it:

“The $175 million bond is collateralized by $175,304,075.95 in cash held in a Charles Schwab account pledged to KSIC, and KSIC has the right to exercise control over that account,” the court filings said.

Right, they already tried to float this shit in pre-trial motions, to the point that they desperately tried to suggest that if it was written up with lawyers in the room and they didn’t explicitly and on the record say “This shit is illegal AF,” then he could assume it was totally legal and thus good to go.

@mitchellepner.bsky.social

PS/ The prosecution has objected to three separate portions of Blanche’s opening (which is rare). Each of those objections has been SUSTAINED (meaning the judge ruled for the prosecution and against Trump).

This is horrible for Blanche’s credibility with the jury, in my training & experience.

301
BeachDem  Apr 22, 2024 • 8:48:55am

“Michael Cohen was obsessed with President Trump, he’s obsessed with President Trump even to this day,” Blanche said. “He rants and he raves about President Trump” and has “talked extensively about his desire to see President Trump go to prison. … He has talked extensively about wanting to see President Trump convicted in this case.”

I think it’s Blanche who’s obsessed. PRESIDENT 5 times in that little diatribe.

So like I suggested the other day, he’s desperately trying to spin his actions to the jury as an attempt to keep all this secret from Melania. You’d have to have a room temp IQ to believe a man who has cheated on two wives and subsequently divorced them gives a flying fuck that wife number three found out he banged a porn star.

That’s going to open a whole can of worms, though, because right now, the prosecution is not allowed to mention Melania. If the defense brings it up, though, all bets are off; and you can bet they are ready to light that whole line of questioning on fire with napalm, if given the opportunity.

I have evenings of watching fireflies and listening to frogs sitting just outside my house. I’m very lucky in many ways.

Luckily, I don’t have to worry much about pleasing neighbors by having a manicured lawn - I share my lot lines with no one but the city. I have several sections covered with at least two varieties of pussytoes that I just let go and only mow down once they’re done flowering. I do the same with the yarrow that occupies another large section of the yard. I feel just letting them grow gives the yard some definition and texture.

The Calvinball Court is capable of rendering unconstitutional decisions overturning any prior precedents and existing laws in service of their true lord and master Leonard Leo.

According to Monday’s agreement, the $175 million will stay as cash in a money market account, Knight Specialty will have exclusive control, but can only use the cash to pay for the bond if needed. The attorney general’s office and the court will get monthly account statements.”

The perfect lawn is how the suburban gentry elevate themselves to aristocracy. The nicer-looking the lawn, the greater your status.

Never once in my life have I lived in a place with an HOA. And from what I’ve gleaned, I’m very happy about that.

Ms. Rosenbaum had so little self-awareness.

As I’ve mentioned before, ‘Objectivism’ is simply the inverse of Stalinism. If Stalin said something was good, Rosenbaum declared it bad and vice versa.

Stalinism was simply a reflection of Stalin’s murderous and malignant narcissism. It was as ‘unreasonable’ a philosophy as possible. That doesn’t mean the inverse is rational.

So Ms. Rosenbaum arfing about ‘Reason’ is fucking hilarious.

Trump calls for police to leave the area around the NYC courthouse where he’s being tried so MAGAs can run wild

@nycsouthpaw.bsky.social

There’s a horror movie quality to watching Trump very deliberately work to gather another large and menacing crowd around a public building to influence the legal proceedings going on inside, while no one in authority acts like it’s a particularly big deal that he’s doing it.

Errors and mistakes happen wherever there is military activity and they must not happen… but the fact that one, or two, or [multiple] soldiers did something wrong, this should not vilify the [entire] battalion,” Gallant says. He says that in such cases, the soldiers are “taken care of.”

No one in the world will teach us what morality is and what norms are,” Gallant adds.

re: #241 Wendell Zurkowitz ((slave to the waffle light))

he was a product of a time and a place that no longer exists.

I am just grateful that it did exist the way that it did

this kind of reminds me of a discussion that I wound up in dealing with Frank Zappa’s music, over on Facebook. I thought I was being daring when I suggested that in spite of his reputation, apparently well earned, I had never actually heard a Zappa guitar solo that did anything remotely for me. I expected immediate flames and backlash. Instead, a number of people just kind of came into the thread to mention that yes, there is a lot of Zappa, presumably done under pressure of trying to pay a full band wages, which is pretty much unlistenable. Someone did mention that the best way to approach Freak Out! is just to think of it in context. Realize it came out in 1966, and consider how absolutely radical it was as a sound for that time. I do think that helps, as has been said here about Beefheart: it has to be considered in regards to the time in which it was produced. Not every great creation has to be a creation that transcends time forever.

I wonder who provided the 175 million in the first place.
