If You Burn a US Flag, Donald Trump Wants to Throw You in Jail and Take Away Your Citizenship

Would-be tyrant Donald Trump is on a roll with his Twitter account lately, and this morning he announced that he wants to jail and revoke the US citizenship of flag-burners.

Of course, in 1989 the Supreme Court ruled that burning a US flag is constitutionally protected free speech. And one of the justices who ruled against criminalizing this act was Donald Trump’s idol, Antonin Scalia.

Scalia said as a jurist who believes in a pure texualist reading of the Constitution, he has made some tough calls in his career, especially in free-speech cases where his vote went against his personal principles.

“If it were up to me, I would put in jail every sandal-wearing, scruffy-bearded weirdo who burns the American flag,” Scalia said. “But I am not king.”

Clearly, though, Trump is having difficulty distinguishing between a king and a president.

And by the way, one of the bad decisions Hillary Clinton made in her political career was co-sponsoring the Flag Protection Act of 2005, which also sought to criminalize burning a US flag. But Trump took this a step further with his call to strip the citizenship of flag-burners — which has also been ruled unconstitutional by the Supreme Court.

Some people on Twitter are saying we should ignore this tweet, because it’s just “trolling” — but I think that’s a foolish thing to advocate. Trump is expressing the right wing id with comments like this, and his tweet has almost 50,000 likes as I write this. If we ignore stuff like this, we risk having it become law while we were looking the other way.

Every tweet by a soon to be president has to be treated with the consideration that it was uttered by a guy who’s going to be president, whether we like it or not. His tweets include his beliefs at a point in time, and the trend has been for him to attack the 1A time and again. He’s all for attacking journalists and people who call him out for lying (and wanting to adopt the British standard on libel/slander/defamation making it easier to sue journalists who say bad things about him - even if they’re entirely true). He’s proposed Muslim bans and his flag burning statements today are yet another affront to the 1A.

As President, he’s responsible for protecting and defending the Constitution, but he doesn’t appear to know what any of that means. Which means protecting and defending the Constitution is up to the rest of us. And that means taking his batcrap insane tweets seriously.

To stop them from seeing your posts, you need to add them to the “Restriced” list and then make sure you change your settings so that everything you post is “Friends Only Except Restricted.” If you post something in “Public” mode (which I’d strongly advise against anyway, unless you want it to go viral), anyone and everyone can see it.

If you don’t know what option I’m talking about, in the FB post box, look for the dropdown menu right next to the “Post” button - from that menu, you can choose who will or won’t see the post (and FB “helpfully” remembers your new setting for every subsequent post…so…just be aware that you’ll always need to double-check the setting to make sure it’s appropriate for that particular post)

It can be difficult to know what to worry about.

On my route to/from work, there’s a location on a main street where a bush comes out from between two buildings and covers the sidewalk completely, making a pedestrian use the street right by a storm drain. I found out which building it belongs to, the one with no address, of course.

Meanwhile, directly across the street two months ago they arrested a felon with an arsenal of weapons on the table and a safe full of meth. He’s out now, and there appears to be a problem with the warrant they got him on.

I’ll go over a block or two.

The issue on that bill Hillary Clinton supported in the past would not specifically outlawed flag-burning. That is somewhat misrepresented here.

What that bill would have done is two things:

a) Prohibited such acts where reasonable suspicion of incitement to violence or danger to safety was to be caused by the act
b) Prohibited the theft of a Federally-owned flag from being stolen for such a purpose (Hence the enhanced penalty over simple theft of other Federal property).

I agree it is an incremental push in the wrong direction, in that it makes a Federally-owned flag somehow more inherently worthy than some other Federally-owned piece of property of equal value.

The incitement portion of the failed bill pretty much falls in the grey area of incitement anyway (lots of things can be called incitement, but intent to incite is also required to convict someone).

That bill in no way represents what the minority-President-not-yet-elect has proposed. Stripping citizenship and outright banning burning a flag was never part of the bill Mrs. Clinton supported. Even late Associate Justice Antonin Scalia voted in favour of striking down laws that were written to prevent flag desecration.

One other thing we need to block: 56th and 5th.

Trump is a creature of Manhattan. It’s where he built his most gaudy sky-palaces. Trump Tower is where he wants to reside as President. It’s where he draws his strength. Activists in NYC need to deny him this comfort. Manhattan needs to become hostile territory where he can’t move for the crowds, or sleep for the shouts outside his window. We need people laying siege to Trump Tower whenever he tries to come home, blocking the Ed Koch Bridge, jamming up Madison Avenue, snarling 60th.

There are more than enough anti-Trump activists in NYC, more than enough anti-Trump donors, and more than enough organizers with experience in Occupy and other campaigns, to make this happen. This is really just a logistical problem, one which we have a little under two months to figure out.

Fixed an error up there. Do not let Richard Spencer redefine what he stands for.

As for flag desecration, we already have a law for that (I USC 4, otherwise known as the US Flag Code). It has no enforcement authority or penalties, but it could be easily amended to provide such.

Then start rounding up wingnuts for flying US Flags upside-down at political rallies, wearing it on clothing, failing to light it properly at night, flying a non-all-weather flag in inclement weather, &c.

In my village I am chair of the Flag Committee (the village put the town liberal in charge of that because I actually know what’s in the Flag Code). The overwhelming majority of my village is made up of conservatives, many of whom, like me, fly the US Flag from gaffs or staffs.

As far as I have been able to tell, the only flags in town that are consistently flown in keeping with 1 USC 4 are the village flagstaff (for which I am responsible), and mine.

In my short time here, I’ve tried to ensure that when a comment has a private section, in my response I either delete that section or ensure I placed privacy tags around it.

That said, it is easy to simply click “quote” and fail to remember there was a private portion of a comment, so one or more might have slipped by me despite good intentions.

Mr. Johnson seems to stay on top of just about every little niggling detail here. Wanna run Microsoft? Windows and Office could use some work. /s

I know when it’s happened, it’s typically people doing it unintentionally, so having the reminder popup helps.

OK now. Since people often forget to use the private comment feature when replying to a private comment, I just implemented some code that will automagically pop up the private comment dialog if you click the Reply or Quote button for a comment containing a private section. This should help remind people to keep private conversations private.

Very nice Charles, altho there remains that http-only protocol issue between sender and receiver(s).
