I was impressed with Nancy’s statement on impeachment. I always had faith in her. Now let’s see where it proceeds from here. Hopefully the committees will finally get Trump’s tax returns and will have experts in financial fraud to investigate them thoroughly.

It was truly dismaying that Muller never looked into the Trump financial records, but maybe that was the price of not getting fired.

I’m not sure that means what it seems to mean. I think it refers to pardons to people who have been impeached.

15

That’s not what that means. It means that the pardon power doesn’t apply to cases of impeachment. So if a cabinet secretary or judge is impeached by the House, the president cannot pardon them to make the impeachment go away

That’s a funny interpretation, but wrong. It says he can’t pardon impeachments, which does mean he can’t pardon himself, but it doesn’t stop all pardons.

So the President cannot pardon himself for any impeachable offenses he committed!

The president pardoning himself for impeachable offenses would likely be an impeachable offense in and of itself. In that he’d essentially be admitting potential liability for criminal acts.

re: #20 Belafon

That’s a funny interpretation, but wrong. It says he can’t pardon impeachments, which does mean he can’t pardon himself, but it doesn’t stop all pardons.

He can’t pardon himself with respect to the articles of impeachment and Senate trial. It’s still unclear that he can pardon himself. My gut answer is that he can not pardon himself for the same reason he can’t be indicted as a sitting president - it is an inherent conflict of interest between the office of president and the person holding office.

No — that’s not sufficient since the embassy may have reasons to be less than honest. The committee needs to listen to the original tape and make their own transcription. Of course, the 18 1/2 minute gap (////) may prevent an accurate report.

You are correct on barring them from holding a position of trust again, but that is entirely up to the Senate, I believe. I believe last person subject to disqualification was Thomas Porteous who was impeached and removed in 2010 (which is also the last person impeached). Before that, you have to go to 1912 to find someone disqualified.

What has me curious now is the timeline of today’s events, i.e. did Donny make the offer of “working something out” before or after Schiff got in contact with the whistleblower’s counsel to negotiate their appearance later this week? In other words, did the WH foresee this shitstorm intensifying rather than deflating and want to “get ahead of it”?

The judiciary is not lost. Most of the appointments that Trump has made were replace Reagan appointees. The next president will likely mostly replace appointees by Clinton and GWB.

As for the Supreme Court, even that is not really lost. Thomas is 71, Alito is 69, and Roberts is 64. Throw in Ginsburg and Souter, and there’s a chance that the next president (if they serve two terms) could have 4 appointments.

I loved Clark’s shoes in the 1970s (though Dave’s right about the beat-down on the soles). But as a young professional many years ago I bought Clark’s casual dress shoes for work and there was always an air pocket or something that I didn’t catch in the store. It would be one quiet step and then SQUEAK all down the hall. It was a deal breaker, because my first job out of college was—-assassin!

The “we’ve lost the judiciary” thing comes up all the time, and it’s never really happened. The closest one side has come would have been the three terms of Reagan/GHWB. Between them, they appointed five justices, but among those justices were O’Connor, Kennedy, and Souter. So the Court never went as hard right as it could have (especially had Bork been confirmed).

I don’t believe that Trump or his pack of feckless gibbons are capable of orchestrating anything that doesn’t fall apart due to abject stupidity, so I suspect it is more they hoped that offering up anything at this point would make it all “go away.” Hence why I’d like to see a timeline of today’s events, because I suspect Donny got boxed in way before the announcement of an impeachment inquiry.

If anything, the announcement of an impeachment inquiry raises the pressure to see the “transcripts” released scrutinized and the original record (if it exists) released to the public. And the whistleblower complaint will likely be compared to the testimony of the whistleblower’s own testimony and any factual omissions laid bare.

If this was indeed an attempt to “play” the Dems and the media, it’s a high-stakes gamble that has every chance of blowing up in Donny’s face.

They will release the Barr summary to the public to control the news cycle; the lesson they learned was that the Barr dishonesty controlled the public impression of the Mueller Report; it worked once so they’ll adopt the same strategy again.

The problem with saying “If we impeach and fail, he’ll just act worse!” is that there’s nothing right now stopping from acting worse. If anything, the knowledge that we wouldn’t take action due to that fear has only emboldened him, as he feels there’s line in the sand he can cross that will lead to anything besides more lines in the sand.

The difference? If we impeach and fail, we now have Repubs out there before their constituents, trying to explain that vote in blue and purple districts/states. The idea that every single one of them will meet with total approval is really rather fanciful. And Dems in the same boat will at least be able to say that they stood up for the law and the ideal that no man is above it.

Not in error, they ruled unanimously that he effectively lied to HM about the need for proroguing Parliament and the need for the length of such. AFAIK, Liz has not weighed in yet on that, but most of those have said any other PM would be forced to resign after such a ruling.

That’s why I like the way this impeachment has started, even though waiting for it nearly drove me insane.

The biggest threat has always been from media both-siderists who will instinctively gravitate to a narrative of Ds impeaching Trump is just partisan bullshit like Rs impeaching Bill Clinton was in the 90s.

That ought to be fairly difficult to do now, with a simple and sordid story of Trump using US aid to extort favors out of Ukraine.

There’s plenty of circumstantial evidence that puts Pence up to his eyeballs in the Ukraine matter. And that matters, because he failed to report the matter or stop it, he became a conconspirator who then lied about the nature/content of the meeting and obstructs justice in the process.

That means a two-fer. Impeachment for the crime and then the coverup.

I didn’t say he would resign, only that they’ll ask him to do so if it looks like he’s going to be an anchor around their necks in November. And since the courts have ruled he can be tried for state charges even if pardoned for federal ones, even the offer of a pardon from Pence will be effectively empty.

I could see Senate Republicans voting to convict if they were assured that the final vote did not get to 67 in favor. Mitch would release “vulnerable” members of the ranks to vote to convict if he believed doing so would raise their chances by enough to squeak out a win in November.

It really depends on what the investigation manages to pry loose. Prior to today any leakers sitting on valuable dirt had no reason to believe it would receive a public hearing, now that mental calculus has changed. It’s going to take a LOT of evidence to get GOP Senators to vote to convict, but it’s by no means out of the realm of possibility.

It bears repeating that less than a week ago, when this story will just starting to percolate, the stated position of the House Dem leadership was that impeachment was still a no-go. As long as Democrats could be bluffed by Republicans and the hostile media into not doing impeachment, then Trump and his goons really were above the law. Since being above the law is the natural desire of right wingers everywhere, they were perfectly happy with Trump’s law breaking etc., as long as there was no risk involved.

Now that there is some risk on the table, team R is much less enthusiastic about supporting any crimes they don’t personally benefit from.

I am pretty sure that the party has moved to a place where God fearing, America loving, hard working Democrats can no longer support them because their entire platform is based on hating Trump and overthrowing our Constitutional Republic form of government and replacing it with a Socialist form of government! Am I wrong? I don’t think so! Your grandpa’s, your dad’s and your former Democrat Party is no longer there!

My reply-
You misspelled upholding with “overthrowing’. You need not be socialist to oppose Trump, or prefer government rather than private law enforcement (including prisons) and enable actually affordable access to medical care via the ACA. Oh and have real support for more than one Constitutional Amendment that happens to be about guns.

Old media spin: Democrats can’t get to impeachment because they don’t have the support or the case.

New media spin: Democrats should hold the phone and btw, nothing really changes with Pelosi indicating that the House is impeaching Trump.

Reality: Being a pundit means never having to apologize for being wrong. Media outlets are falling over themselves to say how little changed with today’s Pelosi statement.

It’s so wrong as to be laughable.

There’s a tipping point that you have Democrats fundraising off holding Trumpworld accountable. You’ve got Democrats demanding accountability and the rule of law be upheld while the GOP fights to defend the most corrupt admin in our nation’s history because their own grasp on power is in doubt. And that makes them dangerous and willing to do what it takes to hold on to what power they have left.

Media will try to both sides the fuck out of things. Fox will do the bulkshit agitprop thing endlessly. They wont do otherwise, it’s in their nature.

Democrats are going to have to redouble their efforts to make all the criminal conduct public and show just how Trumpworld engaged in widespread criminality. This isn’t just about Ukraine. It’s about all the criminality and misconduct. Impeachment needs to cover all of it. And there’s so much that it overwhelms the senses. No one in Trumpworld is innocent, and those defending Trump are themselves implicated in so many ways (crime fraud exception will likely hit others, including Rudy). This isn’t over by a long shot, but today’s actions change the nature of the conversation in a meaningful and lasting way.

The announcement that a “transcript” would be released along with the whistleblower complaint has lead to a sense of false victory, that Trump has somehow “hoodwinked” Pelosi into announcing impeachment before releasing evidence that his call with Zelensky was totally not about investigating Biden. Because after weeks of refusal to release anything to Congress and Trump all but bragging to the press that he withheld the money in exchange for Ukrainian assistance in the election, we’re suddenly going to discover tomorrow that it “never happened.”

The problem with this…is Trump made the phone call to Zelensky. He’s never denied such a call happened, he’s all but bragged to the media that he made that call, and he’s likewise confirmed that it was about “corruption.” So tossing Rudy under the bus when the Dems are now officially sniffing around doesn’t help them in any way and actually turns him into a liability, as he may decide that cutting a deal is better than taking the fall for an ungrateful client.

I think it’s more that American media, and by extension American culture, has defined racism very narrowly for the past several decades. Since the Civil Rights movement, everyone has known Racism is bad. But validating and protecting the feelings of white people is paramount, so American culture began carefully defining what racism is and isn’t. The end result is that to most Americans, racism is hating all people who aren’t white and saying the word ‘n*****’. That’s it. Nothing else is racism.

Thinking your culture is superior because those people have no work ethic and no morals? Not racism. Being suspicious of a black man or boy doing normal things? Not racism. Not wanting your children to marry outside their race? Not racism. Being angry that tax dollars help ‘urban’ people but not caring when tax dollars support white farmers? Not racism.

These people don’t believe they’re racist because they think racism means something very, very specific. They are encouraged to think so because that’s what they see and hear every day in their media, which goes out of its way to assure them that all the racist things they think aren’t really racist, just mainstream.

White House Seeks Deal for Whistle-Blower to Speak to Congress

The precise content of the whistle-blower’s complaint has not been made public. It was found to be urgent and credible by the inspector general for the intelligence community, and is said to involve Mr. Trump and Ukraine. People familiar with the situation said the administration was putting the complaint through a declassification process and planned to release a redacted version within days.

Welp.

White House Seeks Deal for Whistle-Blower to Speak to Congress

Welp.

The law doesn’t say anything about turning over a redacted version. Anything short of what the law requires is unacceptable.

I’ve been working on a browser extension with @shoq that puts Better TweetDeck to shame, by the way.

“Aha! We’ve tricked you! We’re gonna release the transcript and whistleblower complaint tomorrow and show how we totally hoodwinked you!”

*hours later*

“Alright, so here’s the transcript for a call we didn’t record, so you’ll have to take our word that it’s accurate. And here’s the redacted whistleblower complaint, as we can’t allow you to see stuff that we don’t feel you’re cleared to view. So, that’s it, total transparency!”

A transcript sans a recording to compare it to is worthless, as you only have the word of the person presenting the transcript that it is complete and without editing. Just who is it that the WH is prepared to send forward to swear under oath that the transcript is legit and answer questions about the contents of such?

Rudi is loosing it. I’m not sure he’ll make it though the week. Sounds like he’s been doing a whole lot of yelling lately, as well.

So this is how I imagine the White House is tonight:

The Second Coming

BY WILLIAM BUTLER YEATS

Turning and turning in the widening gyre
The falcon cannot hear the falconer;
Things fall apart; the centre cannot hold;
Mere anarchy is loosed upon the world,
The blood-dimmed tide is loosed, and everywhere
The ceremony of innocence is drowned;
The best lack all conviction, while the worst
Are full of passionate intensity.

Surely some revelation is at hand;
Surely the Second Coming is at hand.
The Second Coming! Hardly are those words out
When a vast image out of Spiritus Mundi
Troubles my sight: somewhere in sands of the desert
A shape with lion body and the head of a man,
A gaze blank and pitiless as the sun,
Is moving its slow thighs, while all about it
Reel shadows of the indignant desert birds.
The darkness drops again; but now I know
That twenty centuries of stony sleep
Were vexed to nightmare by a rocking cradle,
And what rough beast, its hour come round at last,
Slouches towards Bethlehem to be born?

re: #137 MsJ

Trump resign? Maybe if he’s promised a pardon. I’m not sure I see it even then.

A Pardon for what? Even the President cannot blanket Pardon someone for crimes that haven’t even been under indictment yet.

The massive mountain of individual crimes Trump and his family are going to be charged and indicted for in the next few years will be eye-watering.

BTW, Trump is going to flee to Russia or some other former USSR state and probably work for RT.

Wow.
Rudy is sweating up a storm. I am pretty sure his PR people keep telling him not to wipe sweat off your head with a sodden tissue.
Rudy tells us he has “5 Ukrainians” who BEGGED for an investigation…..
Rudy gets one of the rare Faux News; “Rudy, Rudy, we are out of time. RUDY! We are out of time.”
