My two cents…
The sword is approx 26-30 inches long…
The thief was not trying to escape…he was For all intense and purpose approaching the student!
There is only one witness…the student!
He needs to shut up and Lawyer up!

That would be my advice. As to what actually took place - impossible to say. There’s the student’s account, whatever forensic evidence may have to say, and the past history of both the student and the burglar.

I’d say things are looking fairly good for the student, but as already noted it’s going to be expensive for him, at best.
