Slate’s floating the possibility of a “grand bargain” between the justices on the two Trump cases - the first being that they knock down the CO disqualification by relying on Justice Jackson’s concerns that it’s a national election so we shouldn’t have individual states hodgepodge picking and choosing who to disqualify. The justices would also find no immunity claims, allowing the criminal cases against Trump to proceed.

I’m not entirely buying into that, because on the merits and the law Trump should lose both outright.

If this is the bargain, I’ll take it though (choking it down). The criminal cases are essential, and it blows all of the ancillary claims of privilege/immunity that glom on to Trump’s immunity claims out of the water too - he wasn’t acting in an official capacity, but trying to subvert democracy by disenfranchising millions of voters despite clearly losing the election.
