If you’re “trying to retain top talent,” how about paying them more or offering better benefits instead of threatening them with a lawsuit if they even think for a second about finding such at another employer? An annual raise, a fat bonus, paid vacation/sick leave, and so many other possible ways to show you support these people and wish for them to stay with you instead of legal threats to ruin their lives if they leave you.
