He was already denied a stay from a single judge, so his only hope now is a full panel reverses that decision. And I suspect that their decision will weigh heavily upon whether or not they believe the appeal has any chance of succeeding. If they feel he’s only delaying the inevitable, then they’ve no reason to grant him a stay.

I didn’t know he tried for a stay to the appeals court already. That certainly changes the equation considerably.
