1. there may be votes to reverse outright
2. there may be votes to narrow the ruling without reversing outright
3. there may be votes to go further than the DC Circuit went
4. there may be a feeling that it’s too important to not weigh in on, similar to the Nixon cases in the mid-70s

Remember that DOJ sought expedited review of this issue from the Court last year (skipping the circuit courts). They refused and punted it to the DC Circuit, which took months; then dilly dallied all this time after the DC Circuit’s decision, before finally issuing a grant. It’s pretty transparent.

For all we know, they have been stringing it out so that they can rule in his favor, jet off to Spain or somewhere for a summer vacation, and leave us with the burning embers of what used to be a justice system and the certainty that the Republican Party will burn down Washington, DC if they have to in order to ensure that he becomes President for Life.

By law, the U.S. Supreme Court’s term begins on the first Monday in October and goes through the Sunday before the first Monday in October of the following year. The Court is, typically, in recess from late June/early July until the first Monday in October.

Ugh, and now #Lawyersky is starting to point out what the angle might be on this: SCOTUS restricted their question to “does the former president have presidential immunity for acts allegedly committed as part of official duties?” What they’re going to do is send this back to the DC Appeals Court and say, “Yes, if the acts are official acts, then presidential immunity is valid. You need to determine that the acts are not official acts before you can deny presidential immunity.” This will then be remanded all the way back up to the DC Circuit Court, who will need to go through a whole briefing/argument process to weigh the merits of the defense. The DC Circuit Court will undoubtedly rule that the acts were not official acts; but this will then get appealed all the way up. SCOTUS will be asked to weigh in again, but if he wins the election, it will be moot.

2. There was agreement to fund things for the coming week so that the bills for #1 can work their way through congress.

Texas has issued no such ruling. But IVF patients like Burzlaff are scrambling to make a plan for their embryos in case that changes. Does she move her embryos to another state? Does she budget to pay for their storage for the rest of her life? Does she implant them at a point in her menstrual cycle when she’s least likely to get pregnant?
