Uh Oh!

Everyone’s favorite crank from Tennessee got hit with a lawsuit!

Kansas City-area man files defamation suit against U.S. Rep. Tim Burchett over social media posts

Burchett posted a photo of Denny Loudermill, alleging he was mass shooter at Super Bowl victory parade

The lawsuit, filed in U.S. District Court in Kansas, alleges Burchett shared photos of Loudermill on his personal social media account, saying he was one of the shooters and referring to him as an “illegal alien.”

Loudermill, a native of Olathe, a Kansas City suburb, attended the parade celebrating the Chiefs’ Super Bowl win. An argument broke out during the parade and ended in the shooting, which killed one person and wounded more than 20 people.

Loudermill’s suit states that he attended the parade and was detained by police following the shooting for “moving too slow” as law enforcement was clearing the area. As he sat on a curb in handcuffs, people took photos of him and shared them on social media, according to the complaint.

Police did not charge Loudermill with any crime and released him.

Burchett, a Knoxville Republican, later deleted the tweet but included a screenshot of it that is still visible in a separate post.

Attorneys for Loudermilk allege he has received death threats as a result of Burchett’s post on X, formerly known as Twitter, and are asking $75,000 in damages for acts considered “willful, wanton, reckless and malicious.”

Well, gotta admit, this is a plot twist I didn’t see coming….

OFFICIALS RAIDED TWO of Sean Combs’ homes on Monday, a law enforcement source confirmed to Rolling Stone, as part of a federal sex trafficking investigation. Led by Homeland Security, the raid was carried out just four months after the rap mogul’s ex-girlfriend, singer Cassie, accused Combs of sex trafficking.

Helicopters and agents were seen swarming Combs’ Los Angeles mansion on Monday afternoon. Footage of the scene appeared to show some men — later identified as Combs’ sons Justin and King — detained and waiting outside the Holmby Hills house. Officials were also present at Combs’ Miami residence. Combs was in Florida at the time of the raid, according to NBC News, and officials reportedly seized his phones before the Bad Boy Records executive was scheduled to leave for a trip to the Caribbean.

A source tells Rolling Stone four Jane Does and one John Doe already sat for interviews with Southern District of New York investigators for a probe related to alleged sex trafficking, domestic violence and racketeering. More interviews are scheduled, the source said.

“Earlier today, Homeland Security Investigations (HSI) New York executed law enforcement actions as part of an ongoing investigation, with assistance from HSI Los Angeles, HSI Miami, and our local law enforcement partners. We will provide further information as it becomes available,” a Homeland Security Investigations spokesperson said in a statement. Rolling Stone has contacted Combs for comment.

Douglas Wigdor, who represents Cassie Ventura and a Jane Doe accuser, says in a statement provided to Rolling Stone, “We will always support law enforcement when it seeks to prosecute those that have violated the law. Hopefully, this is the beginning of a process that will hold Mr. Combs responsible for his depraved conduct.”

No. 1 Biglaw Firm In The Country To Represent Apple In Government’s Antitrust Suit

If the case is as light as some commentators have said, these lawyers are going to have a great time.

The story, as I read it, is that Apple had some texting feature, and a developer wanted to make that available to Android users when they receive texts from an iPhone. After implementing it, Apple specifically changed their code to break that. The government is arguing that Apple is too big of a company in its space to be allowed to do that.

Problem as I read it was that the developer had to hack into Apple servers using an iOS device, often using jailbroken iPhones, in order to get the messaging to work. And then it was going to charge its own customers to have access to what is a free service (They changed when Apple complained). That is, it used Apple’s servers in a way that lowered the security for Apple’s own customers. And piggybacked on Apple technology without compensation. So of the DOJ wants to make that case, there are a lot of unintended consequences.

It will be interesting.

What if Ford did something to their cars that required you to go into the dealership to get it fixed, and then someone figured out how to get around it, but it required adding a module to get around the protection, and then Ford applied a patch that broke that? Should Ford be allowed to have the original feature made so that they force people to go to the dealership to fix it?

The gripping hand to that would be to argue that had Apple made access freely available in the first place, rather than act as a monopolistic entity, the developers would not have resorted to such means and played within acceptable rules putting the blame for those consequences squarely on Apple.

I think those are the fundamental questions. How far can companies go to capture a feature? How much can they be required to implement things in such a way that they can be used beyond their original intent?

44

As I understand it, the registration process required the Android app (Beeper mini) to pretend to be an iOS device in order to get connected to the Apple servers to exchange encryption keys (eventually the only way to set this up after Apple’s blocks was to buy an old iOS device, register your phone number through that phone then add it to your Android phone). This seems a little hinky to me. And should Apple be forced to allow unauthorized access to its private servers through people pretending to be one of their customers so that Beeper mini could work?

I wish Apple had provided an Android version of iMessage a decade ago, as they did with iTunes. But I think the economics are bad. iTunes on Android still brought money in to pay for the servers and perhaps help drive iPhone sales. But iMessages is free so why should Apple pay for supporting a competitor without compensation?

According to this:

WTOP has also received word from petty officer Matthew West from the Coast Guard in Baltimore that it was a container ship flying under a Singapore flag that crashed into the bridge. The vessel, called “Dali,” was headed through Baltimore to Colombo, Sri Lanka, as its final destination, according to Marine Traffic and Vessel Finder maps and data.

Fuel prices in Baltimore are about to go through the roof. Shit prices for everything. Almost the entire port of Baltimore is up river of the bridge.
Now they’re going to have to weigh the needs of the investigation with the desperate need to open a shipping channel through the wrecksge

Yeah, maybe some kind of onboard power failure. Ship’s not that old, either, only 10 years old.

Soviet-era subs have windows in their conning towers, but those are only for when the ships are surfaced to protect the lookouts in bad weather, otherwise they are counter-flooded when the ship is submerged.

Surface combatant, but still bad enough. As I recall it got stuck in Chesapeake Bay and had to be towed back to port where Windows itself was defenestrated.

The only positive thing is that this happened at 1:30 a.m. local time. If this had happened during morning rush hour, say, around 7:30 a.m., then yeah, that would’ve gone down in the history books as one of the worst bridge disasters in American history.

If you ever need to link an article on Why Do Some Vaccines Work Better Than Others?

If someone is vaccinated against the measles virus, they likely won’t get measles.

If someone is vaccinated against SARS-CoV-2, there’s still a good chance they’ll get COVID-19—maybe multiple times.
A quick glance at the above example and one might think the measles vaccine “works,” and the COVID-19 vaccine doesn’t—with “works” implying complete prevention of disease. But what does it mean for a vaccine to be effective? That depends on the virus.

And how much it’s spreading.

Hard to be sure, but you’ll note that it’s the through truss sections that collapsed. It probably hit the stress point just right to cause it to buckle. Apparently there was a construction crew doing work on the bridge at the time too. If the bridge wasn’t in good condition on top of the hit…

Pretty much this. Bridges are designed to put support for the majority of the span in a few key places, namely, where they are anchored to the shore or to the riverbed. You impact one of those places, there’s a whole cascade of failures that occurs as the other anchoring points suddenly take on more load than they were designed to take and fail.

Like modern society, bridges are tensile structures, the pieces are interdependently supporting each other and when an important part goes you can get a real cascade failure.
* Yeah, what Nerdy Fish said in #109

Speculation is there may have been some type of catastrophic failure onboard the ship that may have caused the collision. The ship did have two pilots onboard when it happened, and they would’ve done everything possible to avoid such a disaster. However, if it was some issue with the ship itself that was beyond their control, there’s little else they could do except witness an unfolding disaster.

So TFG now has 9 days to find a 175 million dollar bond. Now, while that doesn’t sound nearly as bad as 450 million, it’s still a sizeable chunk of change. I’m guessing/hoping the thirty or so bond companies he approached previously, and who said they required liquid collateral, will now respond along the lines of, “We like lending money to people who haven’t been found guilty of fraud.”

The trumper billionaires will point up the cash.

Rumor has it that Harlan Crow and other right-wing billionaires have been looking to bankroll Trump’s bond, so all this move did was save them a few hundred million - chump change, to them. Expect that funding to be announced as soon as they can find a way to hide it from the court-appointed monitor.

Does the court care where it came from if it’s not his? I mean it’s still forfeited no matter, so isn’t it better for NYS that it comes from somewhere else? They’ll get more that way.

An unclassified Cybersecurity and Infrastructure Security Agency report said the container ship Dali “lost propulsion” as it was leaving port and warned Maryland officials of a possible collision.

The crew notified officials that they had lost control, the report said.

“The vessel notified MD Department of Transportation (MDOT) that they had lost control of the vessel and an allision with the bridge was possible,” the report said. “The vessel struck the bridge causing a complete collapse.”

There’s always a chance that the harbor pilot(s) make a mistake; see, e.g., the MV Ever Given from the Suez Canal incident a few years back. But the chances are low, and it’s usually much safer to start with the assumption that something went wrong and rule that out (or not) first.

Those big ships don’t exactly stop on a dime. It’s not like when you cut power on a ski boat at full speed and drift harmlessly up to the dock. I read somewhere that a ship of that size moving as slow as 3-5mph would continue moving forward for about a mile.

re: #102 William Lewis

What a horror show and luckily it happened at a time when vehicle traffic is at its lowest for the day. That’s a savings grace, but traffic throughout the Baltimore region is fooked for the foreseeable future, including all ship traffic. Baltimore is a major port, so nearby ports in Norfolk VA, Philly, NYC, and even Savannah/Charleston are going to have to pick up the slack as ships are rerouted.

One thing I noticed from the aerial shot is that there are no major fenders, let alone bridge dolphins ahead of the bridge supports. There are 4 small fender piers, but it looks like the ship just ran right through it as if there was nothing there. It completely wrecked the main span pier and once that went, it took down all the adjacent spans (main span and the adjacent spans). Loss of power is definitely going to get a good look as proximate cause, but other problems relate to the lack of safety fenders or bridge dolphins.

Dolphins are steel and concrete structures designed to deflect and absorb impacts to keep ships well away from the piers.

Sunshine Skyway comes to mind - it lacked the necessary safety dolphins/fenders, and a cargo ship hit one of the piers, knocking the main deck into the water hundreds of feet below. The new bridge there has major dolphin arrays to prevent this kind of scenario from occurring again.

The lack of this critical safety measure is going to come under scrutiny as well. I’m sure they’ll look at the channel geometry and other factors, but this was a good weather incident, so mechanical and other factors are going to get bulk of the scrutiny.

IIRC, there were foggy conditions on the day that happened, and drivers just sailed off into the water below because they couldn’t see that a section of the bridge was simply no longer there.

Stop delaying the Trump trials and hoist Alito and the seditious-adjacent six on their own petard. Demand that the Court rule expediently to make sure that justice is done, and to avoid the possibility that should he win, he’d avoid justice entirely despite being guilty as fuck.

Donald Trump is determined to avoid accountability before the general election, and, so far, the U.S. Supreme Court is helping him.

Trump has no legal ground whatsoever to delay a ruling in his plea for presidential immunity. The reason Trump has nevertheless sought to slow down the immunity appeals process is obvious: to postpone the trial date, hopefully pushing it into a time when, as president, he would control the Department of Justice and thus could squash the prosecution altogether. The Supreme Court has shamed itself by being a party to this, when the sole issue before the Court is presidential immunity. By contrast, Special Counsel Jack Smith has both law and policy on his side in seeking a prompt determination on immunity and a speedy trial soon thereafter. Yet the Court has ignored all that.

As Lizards have mentioned, the collapse of the Francis Scott Key Bridge is gonna be a massive headache - and not just for commuters in the region, either.

In a potentially crippling blow to commerce in the region, the Helen Delich Bentley Port of Baltimore is likely to be shut down after the Francis Scott Key Bridge collapsed Tuesday morning when it was struck by a cargo ship.

Before shipping can resume into and out of the port, crews will need to pull debris out of the water and clear the 50-foot-deep channel that ships use, said William P. Doyle, a former director of the port who now heads the Dredging and Marine Construction Association of America.

“You’re going to have to pick out the trusses and parts of the bridge that are in the water,” Doyle said. “The channel is going to be closed. That means any of the larger vessels that are in the Inner Harbor Port of Baltimore - inside of the Key Bridge - are going to remain there until further notice. All the other ships coming up the Chesapeake Bay are going to have to go on anchorage or divert to another port.”

Doyle quickly began contacting dredging and marine companies on Tuesday, seeing what equipment is available to help clear the water.

They’d need to bring in heavy lift cranes. I know that the East Coast Lifter (a huge crane that helped build the new Tappan Zee bridge span) is in NYC, and it’d take a few days to get it down to Baltimore. There might be smaller cranes available immediately from within Baltimore harbor to help recover and remove smaller pieces. The Navy would need to mobilize similarly - any effort would take days to get the right ships/equipment in place.

I’ve taken another look at the video. There was a bridge maintenance crew on the bridge at the time - note the flashing lights on the bridge. They were doing overnight repairs/maintenance. No idea how many workers were on the bridge.

Also, there’s a splash immediately preceding the pier hit that takes down the span. That’s the ship likely hitting the lone fender protecting the pier. It did nothing to stop the ship or deflect it out of the way.

Daniel Thropp was featured in a Politico article this weekend. Not mentioned was his past.

A Politico story this weekend about how Robert F. Kennedy Jr. is attracting a “whole new kind of political donor” featured a New Jersey man who never cut a check for a federal candidate before he put more than a quarter of a million dollars toward the Camelot outcast’s longshot presidential campaign.

What wasn’t mentioned in the story is that the donor, retired landscaper Daniel Thropp, had been in the news before: He killed his brother with a sawed-off .22 rifle in 2006 and was institutionalized for five years after a judge found him not guilty by reason of insanity.

What’s interesting in this is that as you see the ship approach the running lights all go out for a period, and then come back on, as if the ship lost all electric at that point. If that also caused loss of rudder, that could explain the collision.

Alternative speculation : you see the ship really pour on the power judging from stack exhaust a bit before striking after the power returns, — so that either indicates someone steaming their hardest to avoid the bridge join, or someone steaming hard to hit it…

Federal investigators in South Florida recently probed transactions linked to Jim Biden as part of a criminal investigation,” Politico reports.

“Meanwhile, Justice Department officials prosecuting an ongoing Medicare fraud case in Pennsylvania were seeking information about the activities of President Joe Biden’s brother as recently as last year.”

his lawyer said the president’s brother is not under investigation in Florida or Pennsylvania cases.

So the inevitable Pitchbot: Insiders wonder if the President is politically viable after his brother was mentioned in investigations he is not a defendant in”

Making threats against the judge or judge’s family in a criminal case is great way to get remanded into custody pending the trial.

Start with a gag order banning him from mentioning the case , the judge, the jury, the charges, etc. and from using social media to re-post such comments from his followers then lock him up as soon as he violates this…so 24 hours after the gag order is in place.

Interesting missing bit of context - he’s talking about CFO, Alan Weisselberg here:

He was recently the judge on an unrelated trial of a long term employee, elderly and not in good health. This judge treated him viciously, either you cooperate or I’m putting you in jail for 15 years. He plead and went to jail for very minor offenses, highly unusual, served 4 months in Rikers, and now they are after him again, this time for allegedly lying (doesn’t look like lying to me!), and they threatened him again with 15 years if he doesn’t say something bad about “TRUMP.” He is devastated and scared!

I’m certain the judge will appreciate this interpretation of what happened.

I’m far from an expert on maritime commerce, but even I know that (as has been for a long time), the crews of container ships in international trade are usually “Third World” sorts - ships’ officers and specialists not so much. But it doesn’t look like the nationality of the mariners is of any relevance in the Key Bridge collision. Though the Internet will, as you note, likely opine otherwise.

That video of the bridge collapsing was truly amazing: this is going to be a MAJOR project to replace. Even with Pete Buttigieg on the job…

Baltimore has a couple of major transit projects that are going to be critical for regional transportation -

1) the Frederick Douglass tunnel. This tunnel project replaces the Civil War era tunnel on the NEC with a modern replacement allowing high speed transit through Baltimore.

2) Key bridge replacement - essential for trucks and hazardous material shipments through the region since the tunnels prohibit that kind of cargo. This is essential and critical for regional vehicular transit.

3) there’s also a major mass transit project underway as well.

We’re talking billions of dollars across these projects.

The only thing Andrew Tate is knowledgeable about is sex trafficking.

The answer to my second question, in case it wasn’t obvious, is, “There aren’t any.” Even a trained boat captain would have no way of knowing if the steering input was deliberate or accidental, unless evidence surfaced one way or the other. Given that we know of the Mayday and the power loss, the answer seems intuitively obvious to me, but Mr. Sex Trafficker over here is determined to be as big of a jackass as he can be.

Someone mentioned the Valdez above, and I recently learned that part of what caused that spill is that tankers were supposed to go out to a designated lane far from shore to safely move product, but it was standard industry practice to cut time by sailing as close to the shore as possible…and there was no traffic enoforcement and no rules about overworking crew.

The Valdez was doing what was normal…until it rolled a 1.

Companies always engage in this kind of brinksmanship: get as close to malicious neglect as possible, and when things tip over suddenly “the problem” is not that it was only a matter of time until a catastrophe happened, but because individual actors (ignore those people’s circumstances, but also that their responsibility is downstream of the accountability of the people that hired them and told them what to do) were not able to salvage the win.

Much like Bhopal, the accident was a predictable outcome like a live round is a predictable outcome in Russian Roulette, but the entire system of fast-and-cheap commerce relies on pulling that trigger while the gun’s pointed at poor people and/or commonwealth.

SCOTUS hearing on mifepristone is underway, and it’s exactly as you’d expect. SCOTUS is gonna steamroll and limit access by ignoring precedent, and harms to women who will be forced to carry to term, when doctors can choose not to write those scripts.

If a doctor doesn’t want to prescribe, they don’t. That’s between the doctor and their patient, but the Court doesn’t care what the patient (women) want. They want to put their religious beliefs ahead of all else.

The ship lacked sufficient dolphins that would absorb/deflect a ship. For comparison, the Skyway bridge dolphins - bridge protection system were designed to protect the bridge and withstand the impact of an 87,000-ton ship.

The piers themselves could never absorb a ship strike of this size. That was never within their design considerations (the bridge was built before the Skyway disaster). Construction started in 1972, and opened in 1977. The Skyway disaster occurred in 1980.

We can see this whole phenomenon play out with Boeing.

Management cuts corners on construction overall, management decides to half-ass training on the SuperMax so pilots don’t know how the MCAS engages, but in the breach it’s argued that individual responsibility is the primary cause of each problem.

The efficacy of the work that needs to be done—making a thing that functions as it should—is secondary to profit, and it is part of your lower-tier job to account for how management’s priorities make the work and the product nonviable…up to and including when cutting costs kills people.

Conspiracy has to be the answer because that makes the problem solvable by identifying the malefactor and hurting them. This creates the illusion of control, but also reinforces that bad things can only come from external agents.

Always, always, it’s the rejection of complexity; most of the time, it’s the rejection that the prevailing system created the conditions in which the specific bad event was likely.

and all this from a company for which government contracts comprise 40% of revenues.

(37% USA, another 3% foreign, which would then involve government approval)

At this point my base assumption is that most government contracts are padded to oblivion, and quality control only kicks in if the project could feasibly injure someone with a Congressional vote.

Smedley Butler correctly diagnosed that war is a racket; Eisenhower attempt to describe the progress of that disease in his speech about the military-industrial complex. Now we’re at the point where the government exists in constant parallel processing with giant lumps of private money, and government only serves the people when that doesn’t interfere with number go up.

People really do think they understand the world via fiction. Look at how many sour motherfuckers imagine that they should have been a Horatio Alger protagonist, and when that didn’t happen they switched over to some kind of Randian “I’m being fucked over by the mediocrities” rage.

Some tour guide in Astoria, OR, made it sound like the mouth of the Columbia was the most treacherous sailing anywhere, necessitating a Harbor Pilot.

The mouth of the Columbia River is notoriously nasty. Large river feeding into ocean within a relatively constrained valley instead of being a broad estuary like the Mississippi or various rivers entering a bay first. Often carrying fairly large logs (especially a century or so back). The sandbanks at the mouth shift constantly. And the outflow fighting the tide can make things very choppy.

That stretch of coast is known for ship wrecks and I think the museum in Astoria had a display showing them. Plus there is still the wreck from 1904(?) rusting away on the beach in the state park just to the south.

This itself is giving too much credit; the point is to say the line again.

What really happened, how frightening, how sad, how scary, how complicated to fix, is unimportant compared to saying the line again.

And it’s not even a position held in good faith: conservative nativism and isolationism is performative but substanceless. As politicians and commentators they exist to say whatever the system of ownership and exploitation needs said moment to moment, and there will be no consistent follow-through.

What happens next can’t be sakoku because the US is an imperial metropole: it needs cheap shit from everywhere else to even minimally function; “immigrant labor” props up whole industries; and the people that take that value are the people that FOX and the GOP respond to. Indeed, by all indications what’s coming is actually…much worse that genuine isolation, because it makes more explicit and aggressive the coercion we apply to poorer countries (that’s what unilateral deals are: a poor as shit country trying to make a deal with the richest, most-coup-backing MFer on the planet), effectively re-adopting the banana-war mode of “we don’t care what you do, we’re just here for the money” as international policy…but at the same time creating tons and tons of new niches of exploitation—child labor, penal labor, retiree labor—and expanding overall precarity such that people cannot help but participate.

They’ll only get rid of immigrants to the extent they can fill those same positions…at the same compensation level…with Americans. They’ll only bring home manufacturing if they can cut the same corners they do in Jakarta.

All the “anti-immigrant” stuff is just reinforcing that core conservative premise of natural unequalness: problems only come from inferiors, problems are solved by pinning those inferiors in place. They’re repeating to their audience they’re the better kind of people at all times…and the implication (and more and more the declared text) is that America can only be fixed by fully encoding this caste system into governance.

Whether it’s presented as inevitability for eugenic reasons or Norman Vincent Peale reasons, some people are just meant to die in mines in some forgotten corner of the earth, and some people are just meant to die in refinery accidents in a poor town in the Midwest.

EVIL DOES NOT EXIST - Official US Trailer

Synopsis: In the rural alpine hamlet of Mizubiki, not far from Tokyo, Takumi and his daughter, Hana, lead a modest life gathering water, wood, and wild wasabi for the local udon restaurant. Increasingly, the townsfolk become aware of a talent agency’s plan to build an opulent glamping site nearby, offering city residents a comfortable “escape” to the snowy wilderness. When two company representatives arrive and ask for local guidance, Takumi becomes conflicted in his involvement, as it becomes clear that the project will have a pernicious impact on the community.

There was only one bridge that made me nervous in my Bunky Big Rig. It had issues and pieces would fall off almost weekly. When they completed US RT 1, you could avoid it. I went over it a hundred times at least. Both ways.
It went over the Chesapeake and Delaware Canal at St Georges Delaware on US 13.
St Georges sits on either side of the canal.
Temporarily closed it says.
Opened as a 4 lane, made a 2 lane for safety. You can see the wear and tear on closeups. It was a pothole laden crossing.
You could feel this shake as you rode on it slow in traffic….

Sat view. You can zoom in to view them both.

The only bridge that I’ve ever had concerns about - the Pulaski Skyway. 2 lanes each direction - 10 feet lanes - no center median/barrier with everyone driving 40-50mph. It even has left lane exits. I didn’t drive it that often, so it was not as bad as the old Goethals bridge, which was also 2 lanes each direction, but it at least had a center barrier.

I’ve been on the other NYC metro bridges when it was windy, and you could feel the sway.

The Brooklyn Bridge never had that problem (because Roebling designed it as both a cable stayed and suspension bridge) and it used to carry rail traffic before those were removed to make way for additional car lanes.

You want to talk scary bridges:

By the 1960s, the Grace Memorial Bridge had become functionally insufficient…In 1995, the Grace Memorial Bridge scored only a 4 out of 100 (4 percent), or an F, in safety… Construction started in 2001 and the new bridge opened in July 2005, at which point the Grace Memorial and Pearman Bridges closed to traffic permanently.

Going to Charleston in the early aughts was quite an adventure.

Why is Ronna seeking legal representation? I thought Conservatives were all about at will employment where employers can fire you for any dang reason.

Bye Ronna. Go join Fox News (if they will have you given how Trump feels about you).

One day after he compared himself to Jesus Christ, Trump is now selling a $60 “Trump endorsed” Bible.

All the parts about theft and adultery being wrong are edited out.

Dropping the anchor won’t just instantly stop a massive cargo carrier like this. Maybe the silly folks think it’s like the emergency brake on their car or something.
