For as much has been said about this subject here lately, it was always my understanding that as long as the proper fees are paid for public performance rights to the organizations that administer them (ASCAP, BMI, or SESAC), organizations (such as the GOP campaigns, the RNC, or anyone else) are not legally obligated to ask artists for their explicit permission to use their (recorded) music at their events and that artists don’t really a legal right to refuse those performances of their (recorded) music.

Of course, as an artist, Charles would know much more about this subject than I (side note: I majored in radio/TV and did my stints on-air in school). It seems to me that if the attendant fees have been paid to the performing rights orgs and the artists object to who is using their music, the users can just tell the artists’ lawyers to pound sand and basically just ignore the artists’ requests and the C&Ds (like Bachmann seems to be doing now). For a political campaign to C&D use of artists’ music by request seems, to me, more of a courtesy than a legal requirement.

Someone correct me, if needed, please…
