Katrina and the Waves Join Tom Petty's Fight Against Michele Bachmann
Katrina & The Waves – whose 1985 song "Walking On Sunshine" was played by Michele Bachmann at a South Carolina campaign rally on Tuesday – have issued a statement on their website:
Katrina & The Waves would like it to be known that they do not endorse the use of 'Walking On Sunshine' by Michele Bachmann and have instructed their lawyers accordingly.

The google one is good because anyone searching for, say Michele Bachmann might get an LGF page link with the title "Batshit Crazy Loon Speaks!" that has a few +1s on it and be more likely to click.

For as much has been said about this subject here lately, it was always my understanding that as long as the proper fees are paid for public performance rights to the organizations that administer them (ASCAP, BMI, or SESAC), organizations (such as the GOP campaigns, the RNC, or anyone else) are not legally obligated to ask artists for their explicit permission to use their (recorded) music at their events and that artists don't really a legal right to refuse those performances of their (recorded) music.
Of course, as an artist, Charles would know much more about this subject than I (side note: I majored in radio/TV and did my stints on-air in school). It seems to me that if the attendant fees have been paid to the performing rights orgs and the artists object to who is using their music, the users can just tell the artists' lawyers to pound sand and basically just ignore the artists' requests and the C&Ds (like Bachmann seems to be doing now). For a political campaign to C&D use of artists' music by request seems, to me, more of a courtesy than a legal requirement.
Someone correct me, if needed, please...

Well, they could start by getting permission to use music and pay royalties to the artists instead of waiting for embarrassing letters from lawyers which generate bad publicity.

You may well be right. I know very little about music law. I think the point may not be to get them to stop, per se, but to send a message that the musician is not endorsing the candidate, and doesn't like them.

I know it's high on my "to do list". Why last night I couldn't get a wink of sleep just thinking about poor old Tom Petty. It leaves me wondering as we've reached this critical juncture in American life. Will we survive the continued use of Tom Petty's song by the Bachmann campaign as Americans and with our cherished values intact?

If the campaigns haven't paid their performance fees to ASCAP, BMI, and/or SESAC, then I hope the performance rights orgs (which are notorious for going after licensing scofflaws, most especially ASCAP) and the artists nail Bachmann and her campaign to the wall.

Perhaps the next governor might decide that the Church property tax exemption was just an expensive entitlement?
Note, I'd not want that to happen. It would kill my church. However the comparison seems valid to me since my wife's dad grew up in a "company town" with his father paid in script. Only their moonshining relations had real money.

re: #23 talon_262
The problem is that of all the artists who have issued C&Ds:
Bruce Springsteen (Reagan)
Tom Petty (Bachmann)
Jackson Browne (McCain)
Foo Fighters (McCain)
Heart (McCain)
Rush (Rand Paul, natch)
Van Halen (McCain)
John Mellencamp (McCain)
Joe Walsh (Illinios Senate candidate Joe Walsh, believe it or not)
Bon Jovi (McCain)
Only one artist has said they got paid a licensing fee. That was Heart - and they took the money McCain paid for 'Barracuda' and donated it to Obama's campaign.
You'd think maybe they'd have learned by now.

Don't get me wrong. I'm not defending Bachmann misuse of of the song at all. It's just that my visceral reaction is that Petty is making a political statement and a lot of people may resent that.
Think Alec Baldwin, Sean Penn, etc.
The difference between Petty and the Chicks is that Petty has decades more in the business with loads of pull and goodwill with the fan base, which, unlike with the Chicks, is spread wide and deep.
Seems like it's Petty's turn to not back down, as he sang...and I don't think he will or should.

What political statement is Petty making? None. All he's saying is "don't use my shit without permission?"
And I'm thinking his fans would expect him to do just that.
Petty won't lose a dime, and his fans will still love him. Bachmann's cult members, not so much. But they probably never bought a Petty album in their lives anyway.

Divorce, especially with rich folks is pretty much death! I know an attorney who left his wife for the young model. He's broke now. An attorney!!! lol, karma.

Ha, Matt Damon. This is for Remember TonyC. I am really into the Bulger case. I don't know, been hanging out with some Bostonians who gave me the low down. Watched The Departed the other night.

not good...it's still raging, but will probably run out of fuel...a plane flew over the site to measure radiation in the air today...no results yet...but I tell you bro, it will wrench your heart out to look north from ABQ and see all the smoke...it's another minor tragedy... that forest will not grow back in 5 lifetimes...very depressing if you love the land like so many of us down here

His bro was in court. The consensus with my buds is he helped Whitey. Found 800K and a false wall hiding 30 guns. 80 year old, dude drove by me on the 5 on his way to Mexico to buy cheap prescription drugs!

Remember watching the home run race? Then to find out? They were the bad guys, way more than Barry and all the other dudes (not caught) that followed.
