I mean, the judge has to take the bullshit seriously. They don’t want to get the entire conviction overturned because they didn’t at least consider the possibility that there’s an actual legal argument underlying the oversimplified layman’s headline. With that said, I would expect their reply to be brief and something along the lines of, “Rules are rules, and the defendant should not be any exception to them.”

The judge gets to say ‘IS NOT’ instead of ‘should not be’.
