Honduras Coup Update

Here’s the latest news from the coup in Honduras, where pro-Zelaya demonstrators showed up at presidential offices today, as the Obama administration tried hard to seem like they weren’t totally surprised: Protesters Confront Soldiers After Coup in Honduras.

TEGUCIGALPA, Honduras — One day after the country’s president, Manuel Zelaya, was abruptly awakened, ousted and deported by the army here, hundreds of protesters massed at the presidential offices in an increasingly tense face-off with hundreds of camouflage-clad soldiers carrying riot shields and automatic weapons.

The protesters, many wearing masks and carrying wooden or metal sticks, yelled taunts at the soldiers across the fences ringing the compound and braced for the army to try to dispel them. “We’re defending our president,” said one protester, Umberto Guebara, who appeared to be in his 30s. “I’m not afraid. I’d give my life for my country.”

Leaders across the hemisphere joined in condemning the coup. Mr. Zelaya, who touched down Sunday in Costa Rica, still in his pajamas, insisted, “I am the president of Honduras.”

The Honduran Congress late Sunday officially voted Mr. Zelaya out of office, replacing him with the president of Congress, Roberto Micheletti, who said Monday that he would resist pressure from other nations demanding the reinstatement of the ousted president, news agencies reported.

In Washington, Secretary of State Hillary Clinton, the last senior member of the administration to visit Honduras, just three weeks ago, said that the United States was working toward “full restoration of democratic order in Honduras.”

She said that the situation in Honduras “has evolved into a coup.” But when pressed by a reporter, she refused to say explicitly that the United States was demanding that Mr. Zelaya be returned to power, although senior administration officials pointed out that the United States had signed on to an Organization of American States statement on Sunday that included such a demand.

“We haven’t laid out any demands that we’re insisting on, because we’re working with others on behalf of our ultimate objectives, which are shared broadly,” Mrs. Clinton said. But, she added: “We think that the arrest and expulsion of a president is certainly cause for concern that has to be addressed. And it’s not just with respect to whether our aid continues, but whether democracy in Honduras continues.”

Let's see. Both the legislature and the Supreme Court voted to remove Zelaya on charges of attempting to violate the provisions of the Honduran Constitution to illegally extend his tenure as President past its duly-certified expiration date. His attempt was in the form of a type of plebiscite specifically prohibited by said Constitution.

To me, that sounds more like an impeachment than a "coup".

Which probably explains why Obama and Hillary are so determined to put Zelaya back in the center seat.

We just can't have Presidents being compelled to obey the law of the land, now can we?

Honduras' Constitution, broadly based on the U.S. Constitution, was officially adopted upon the nation's independence from the United Provinces of Central America (Guatemala and Panama) in 1838. (All had previously been Spanish and, later, Mexican possessions.)

Obviously, it's yet another "outmoded document" in the eyes of our "best and brightest".

A couple of things here, a) he tried to break the law and was overruled by the Honduran supreme court which even instructed the military not to follow his directions with regard to the referendum and b) a person is known by who he/she keeps company with and this guy is friends with Chavez, Castro and other thugs in waiting. Honduran Constitution. I haven't read the whole thing yet, but it appears quite different than our Constitution.

Article 373: Only congress may approve amendments or referendums with a 2/3 vote.

Article 374: Bans any amendments to change the President's length of term.

Article 42: If you're found guilty by the congress or high court of inciting, encouraging or supporting the continuation or reelection of the President, you lose your citizenship.

He was most definitely illegally putting up a referendum for a vote. He was constitutionally barred from doing so. Chavez did the same thing. Chavez provided the referendum forms for Z. Military, Supreme Court, and populous all said, "No way, rules are for rulers, too." So in that last sense, you're right, he's no Chavez .

What am I missing? The Congress voted him out of office, and he refused to go. OK, does the Congress vote for the President? If so, this is cut and dried. He was voted out. Some people don't like it, and they aree rioting. So what? That is an internal matter.

Mr. Zelaya’s ouster capped a showdown with other branches of government over his efforts to lift presidential term limits in a referendum that was to have taken place Sunday. Critics said the vote was part of an illegal attempt by Mr. Zelaya to defy the Constitution’s limit of a single four-year term for the president.

Early this month, the Supreme Court declared the referendum unconstitutional, and Congress followed suit last week. In the last few weeks, supporters and opponents of the president have held competing demonstrations. The prosecutor’s office and the electoral tribunal issued orders for the referendum ballots to be confiscated, but on Thursday, Mr. Zelaya led a group of protesters to an air force base and seized the ballots.

When the army refused to help organize the vote, he fired the armed forces commander, Gen. Romeo Vásquez. The Supreme Court ruled the firing illegal and reinstated General Vásquez.

As the crisis escalated, American officials began in the last few days to talk with Honduran government and military officials in an effort to head off a possible coup. A senior administration official, who briefed reporters on the condition of anonymity, said the military broke off those discussions on Sunday.

It seems that 2 branches of the government were in agreement that the President was usurping the law. Is it a coup when the military sides with the country's Congress and Supreme Court and reinstates the law?

Technically the coup probably is illegal, anyone know what the articles of impeachment or method of removal are for Honduran presidents? I would wager they weren't followed to the letter this being Central America. On the other hand it's pretty transparent that Zelaya was trying to import Chavez's Bolivarian revolution, and that he was ignoring court orders. The grounds for removal appear to be there even if form might not have been followed.

The American public must be very confused about what's going on in Honduras and Iran and about whom to root for. But it seems, from what I can grasp, that the protesters in Honduras are on the anti-Democratic side -- the opposite of the Iranian situation.

Do I have this correct? :

Manuel Zelaya is a socialist had in the past had been legitimately elected, but he just recently took steps to dismantle Honduras' democratic system, and basically install himself as president-for-life, a la Hugo Chavez (who supports him, naturally). The army stepped in and staged a coup in order to preserve the Democratic system, not destroy it.

They want to oust Zelaya and later, when things calm down, go back to democratic elections again.

Right? Or wrong?

Honduras's legistlative and judicial branches impeach their president according to their own constitutional rules and use the military in a restrained manner to seize the impeached. Thats a coup.

Technically the coup probably is illegal, anyone know what the articles of impeachment or method of removal are for Honduran presidents? I would wager they weren't followed to the letter this being Central America. On the other hand it's pretty transparent that Zelaya was trying to import Chavez's Bolivarian revolution, and that he was ignoring court orders. The grounds for removal appear to be there even if form might not have been followed.

If the President is found to be in violation of the law by his Congress and their High court, he is subject to removal. They found him guilty and he decided to continue to flaunt their laws by having his supporters break into military offices to distribute ballots. It became obvious he was trying to stage a popular movement against the government so the high court ordered the military to remove him from the country which was legal. He had his due process under their laws.

The American public must be very confused about what's going on in Honduras and Iran and about whom to root for. But it seems, from what I can grasp, that the protesters in Honduras are on the anti-Democratic side -- the opposite of the Iranian situation.

Do I have this correct? :

Manuel Zelaya is a socialist had in the past had been legitimately elected, but he just recently took steps to dismantle Honduras' democratic system, and basically install himself as president-for-life, a la Hugo Chavez (who supports him, naturally). The army stepped in and staged a coup in order to preserve the Democratic system, not destroy it.

They want to oust Zelaya and later, when things calm down, go back to democratic elections again.

Right? Or wrong?

I'm no Banana Republicanologist, but that's the way it looks to me....

More precisely, the nation's Supreme court found him in violation of the nation's Constitution, for which the only legal remedy under said document is removal from office. The legislature confirmed this by majority vote. The Army simply carried out the will of the Court and legislature. In event of an impeachment and conviction of a U.S. President, it would most likely be United States Marshals who took him into custody, removed him from the White House, etc., but the principle is the same. An impeachment, not a coup.

If the Army had acted unilaterally, without the orders of the high court or legislature, that would be a coup in the legal definition of same. I expect The One and The ...SecState to claim the Army "jumped the gun" and then somehow "forced" the court and legislature to retroactively "bless" their actions. the timeline of events does not support such an assumption, but the First Rule of our new enlightened administration is, "When the facts conflict with the theory, dispose of the facts."

I admit to not knowing that much about Hondurian politics, but it seems to me that there was a leftist thug president in place who attempted to change the constitution to take the country closer towards dictatorship just like that thug in Venezuela, Chavez, a person who himself was behind a coup in his own country.

But did the military take over the government or just provide the rail they rode El Presidente out on? I don't recall seeing any General named ruler and I thought they had transitioned to the correct civil authority directly. I've been busy and not watching too closely, so I may have missed it.

Even so, what if it was a coup? Zelaya was clearly trying to usurp the constitution (with substantial assistance from Chavez). It might be distasteful to us how the president was removed but he was not going on his own. As far as I know, nobody was killed.
He obviously lost the command of the military and he won't be going back in spite of what "the world" wants.

Those "military troglodytes" are not gonna come back anytime soon, you can rest assured.
Because the darn old cold-war is long past and militaries of Latin American countries know it. They well know it that they'll receive no, zero support for a coup d'etàt from the outside world and thus their reign would only last for a very brief moment.

And that is exactly what you can observe now in Honduras. The generals instated the new president immediately to resort to democratic rule of law.
Formerly, in the times of the cold-war they'd have held onto power. Not anymore. Even they have developed (evolved).

Apparently Not quite a coup.

Congress, the courts, and the military joined forces to send "Mad" Mel packing. In a deliberate, bipartisan manner, they selected a new president to serve until regular elections in November.

Now, the Obama administration is in a pickle. Utopians in the administration believe the Organization of American States, Hugo Chávez, Fidel Castro, and the State Department can all work comfortably together to put Zelaya back in power and, thus, "defend democracy." But "Mad" Mel's penchant is for mob democracy. And realists fear a restoration to power would only produce vendetta politics and populism of the worst sort. A few souls in Washington are leery about promptly delivering Honduras into the eager hands of Hugo Chávez and company.

I'm no supporter of Zelaya, who was trying to get the rules changed so he could be president for life like Hugo Chavez, but on the other hand, when the army comes in with guns, grabs the president and expels him from the country -- well, that's no longer a simple impeachment proceeding. The word "coup" fits, whether there's a legal basis behind the impeachment or not, when the military takes over the government.


The military didn't take over the government. They removed the President by order of the court and the congress and his successor immediately took his place.

For Latin America, this was a relatively smooth transition of power as things go down there. I'm not going to get my knickers in a twist because form wasn't followed; historically it's been the President and the army in Honduras strong arming the legislative and judicial branches, so the army siding with the other two branches is a refreshing change. Was the full legal form followed for removing a president? Probably not.

I got that a judge ordered it, and once the military tossed out the President, the Congress accepted "his resignation" and appointed a new leader, but it was a coup.
Unless someone shows me the Constitution of Honduras allows the Supreme court to order the military to depose a elected President by force, it's a the coup the world is calling it.

That was Hurricane Mitch - in 1998. And we helped plenty. And have been a big help before and since.

They are not ungrateful .... at least most of 'em. I spent three years there, returning in late 2006. I think Mel snuck up on them. I was there during the election and I don't think anybody had any idea he was a Chavez in the making.

I pray (well, OK, I don't pray much ... but I fervently hope) that they've seen the last of that guy.

In a sign of solidarity with Vásquez, the heads of all three branches of Honduras’ armed forces, along with the Secretary of Defense, submitted their resignations to the president.

President Zelaya has reportedly named the chief of the Presidential Guard to replace Vásquez. Honduras’ Attorney General, Luís Alberto Rubí, has ruled the ousting of Vásquez to be illegal and called for his immediate reinstatement.

Just doesn't sound like a military coup is what they were planning.

According to the ever evolving leftist meme of statecraft, a president who is "democratically elected" can disregard the legislative and judicial branches, get help from a foreign military, and stage what amounts to his own sham election if he wants an additional term (unless of course he is a Republican and this is the US we are talking about).

That, friends, is an inescapable and logical inference from the reaction to the Honduran constitutional crisis in liberal, media, and other leftist circles.
We probably cannot save Honduras from an authoritarian caudillo in the Castro/Allende/Chavez mold at this point. Our population is too heavily indoctrinated with misapplied and loaded terminology (like "coup"), weasel words, and common bigotry.

Coup, not a coup, whatever. The point is that this event obviously lines up neatly along left/right fault lines when you measure the reactions. You find Obama's response to be acceptable in this instance, and you find Obama's response to the Iran bloodbath also accceptable. It's all good when you ally politically in all circumstances. It certainly keeps life pretty clean and simple.

I find it kind of disturbing to think like that, but that is just me.

My take on the coup/not coup is that there is a lot that is not known. I strongly suspect however that the good ex-President in Honduras had a plan and that the snake just had its head cut off - metaphorically, which is good given the potential bloodshed there.

The very fact that someone else makes the decision for you is scary, no? When dealing with private insurers there is a bit of this, but a conclusion or solution can be reached more or less amicably. Yep, the "democratically elected" president is the government and the law to them. They contradict themselves of course by disregarding the Honduran congress, which was likewise democratically elected, but a representative body like a congress doesn't have the charisma of a supreme leader. Their military is tasked with enforcing the constitution. Last Thursday, the attorney general asked the congress to impeach Zelaya. Once the AG, congress and Supreme court had made their decision, Zelaya refused to step down. He'd already had due process under their laws so the military was ordered to remove him from the country because Zelaya's supporters had already started distributing the ballots for the illegal vote and Zelaya had made it clear he was going to hold the election.

The military had a role to play that is dictated by their constitution in order to maintain a stable government. Their constitution may not be up to our personal standards but it was designed for stability and as we saw this weekend, it worked. Every branch of government was in agreement, the president was removed from power and taken out of the country to prevent Zelaya from pulling a Chavez.

Charles is wrong. This process was done by the book.

PoliBlogger has read the Honduras Constitution. There might not actually be an impeachment provision in the Constitution - but what Zelaya did triggers more dreadful clauses than anything like that.

The main law in question here: nobody may “incite, promote or aid in the continuation or re-election of the President”. Someone who does that is no longer a Honduran citizen.

Honestly, having lived through that era, I think no one really knew just where to go from there. We had lots of rocks and stuff but the science had not even formulated the questions in relation to it all.

While there are plenty of constitutional provisions to explain why the Supreme Court of Justice blocked Zelaya's plebsicite, I can find no constitutional provision that makes the order to arrest, exile and depose Zelaya a legal maneuver.

I have further consulted with three other polisci profs who study Latin American and we all agree that the move to oust Zelaya was a coup and we have yet to figure out any legal justification for the action.

Yes, I have been looking through the Honduran Constitution, but I reached the opposite conclusion that you ascribe to me. While there are plenty of constitutional provisions to explain why the Supreme Court of Justice blocked Zelaya's plebsicite, I can find no constitutional provision that makes the order to arrest, exile and depose Zelaya a legal maneuver.

I have further consulted with three other polisci profs who study Latin American and we all agree that the move to oust Zelaya was a coup and we have yet to figure out any legal justification for the action.

And yet it was the Honduran Supreme Court that ordered it. Would they not be the final arbitrer?

Honduras Defends Its Democracy
Fidel Castro and Hillary Clinton object.

Hugo Chávez's coalition-building efforts suffered a setback yesterday when the Honduran military sent its president packing for abusing the nation's constitution.

It seems that President Mel Zelaya miscalculated when he tried to emulate the success of his good friend Hugo in reshaping the Honduran Constitution to his liking.

But Honduras is not out of the Venezuelan woods yet. Yesterday the Central American country was being pressured to restore the authoritarian Mr. Zelaya by the likes of Fidel Castro, Daniel Ortega, Hillary Clinton and, of course, Hugo himself. The Organization of American States, having ignored Mr. Zelaya's abuses, also wants him back in power. It will be a miracle if Honduran patriots can hold their ground...

Even Wiki clarifies...

In addition to the Supreme Court, Zelaya's referendum was declared illegal by the Congress, the country's attorney general, and the country's top electoral body. The Congress began discussing how to impeach Zelaya. On June 27, 2009, thousands of protesters opposed to Zelaya's rule marched through the capital city.

Trust me, "capitalistas" was a dirty word in post-Franco Spain when the international Stalinists & socialists swarmed back into the country & tried to ignite class warfare like Obama's doing now.

Anyone with a nice car got called "so capitalista!" and had their cars vandalized. Partido Comunista de Espanya ACORNISTAS came house to house threatening to take your house. I was a teenager visiting during these ACORN like campaigns, and answered the door. Pretty shocking for an American to have thugs threaten to take your private property like those Socialist/comunist community organizers did.

Honduras is fighting back by strictly following the constitution. The Honduran Congress met in emergency session yesterday and designated its president as the interim executive as stipulated in Honduran law. It also said that presidential elections set for November will go forward. The Supreme Court later said that the military acted on its orders. It also said that when Mr. Zelaya realized that he was going to be prosecuted for his illegal behavior, he agreed to an offer to resign in exchange for safe passage out of the country. Mr. Zelaya denies it.

Implausible Implausible deniability. The leftist MSM will continue to paint this as a de facto coup. Adding to this is the military angle which they will use to prosecute their intentions -- and we know how the MSM really feels about all military bodies in general.

The military in Honduras has many functions. One function is to disperse ballots in elections. The military does this because they are politically NEUTRAL. Compare that to ACORN here in the US.

I remember that time. It was as though the 1930s communists had been kept in suspended animation outside the country, with none of the moderating influence of Kruschev and his successors seeming to have affected them at all. The American public must be very confused about what's going on in Honduras and Iran and about whom to root for. But it seems, from what I can grasp, that the protesters in Honduras are on the anti-Democratic side -- the opposite of the Iranian situation.

Do I have this correct? :

Manuel Zelaya is a socialist had in the past had been legitimately elected, but he just recently took steps to dismantle Honduras' democratic system, and basically install himself as president-for-life, a la Hugo Chavez (who supports him, naturally). The army stepped in and staged a coup in order to preserve the Democratic system, not destroy it.

They want to oust Zelaya and later, when things calm down, go back to democratic elections again.

Right? Or wrong?

To take your argument (as representative of most of the posts I'm seeing here) to its (il)logical conclusion, you are saying the Honduran military had to destroy democracy in order to save it. Now I hate using the term "Orwellian," since it's such a cliched term, but I am reading post after post with such perverted inversions of reality, logic, and truth, that I expect before long I will see posts chanting the mantra "2+2=5."

The military coming suddenly in the dead of night to shuffle the elected president into exile--in the absence of unconcealed due process to establish whether he committed an impeachable offense--and installing their own chosen leader, is not anything less than an anti-democratic coup.

hey sleepyhead, perhaps if you would spend a little time studying the facts, you would understand the sentiment and rationale behind many of the posts. I recommend the referenced WSJ article and the subsequent comments (many of them from educated Hondurans), for starters. perhaps then you would be understanding of the real situation, that is, a shameless, unapologetic POWER GRAB. the ousted president was attempting to institute a referendum defying an irrevocable constitutional article regarding term limits, to wit: ONE four-year term for all presidents! your first clue should have been the involvement of chavez, castro, ortega, and ama/clintonista. now get to studying so you can make informed comments regarding this historic event.

The way that I see it, Hondo's president tried to usurp the power he has under the countries constitution, but the other branches of Gov't did their job and followed the law, following the rules of remove him, and placing the proper people as defined by their laws. We should say to them, good job. Democracy in action.

It's ugly, but this is why we have checks and balances in our government. What happened in Honduras is what would have happened in the US if Richard Nixon chosen to order his remaining supporters to riot and kill the police, rather than retiring in disgrace.

The system is working as designed, removing the truly power-mad despite the tyrrany of the majority. If Obama decides to do the same thing Zelaya did, I for one will sleep better at night knowing that something like that could happen here.
