Video: Judge Says He Will Have to Consider Jailing Trump if He Violates Gag Order

Law • Views: 13,251

So everybody who goes on trial for serious crimes gets at least ten violations of a gag order without being jailed, right? Because nobody is above the law?

Judge Juan Merchan has found former President Donald Trump in contempt for violating the gag order in the hush money trial for the 10th time and said he’ll consider jail time going forward. #CNN #News

While I welcome Merchan’s “Next stop is the clink” speech, the fact that he threw in a “You’re a former prez and maybe the next one, and I really don’t want to do this” qualifier really makes me question his resolve.

Quite frankly, that kind of phrasing just signals “I ain’t gonna jail you, I don’t have it in me.”

And it won’t be jail. It’ll be house arrest in VonShitzenpantz’s fucking penthouse in Midtown, where he’ll still be allowed to do whatever the fuck he wants.

That’s assuming Merchan isn’t assassinated by Trumps Secret Service detail.

But you get the drift.

See, this is the sort of shit we’ve come to expect when courts deal with rich defendants, a lot of empty hot air that really means little because the judge lives in fear of pissing off his rich patrons. $1000 for violating a gag order is financially crippling to someone who lives paycheck to paycheck, but to someone who has the money to buy a gold toilet it’s pocket change. We all know he’s never going to put Trump in the clink because rich guys don’t go to jail, they pay fines and pretend to be chastised in public before reaming the judge behind closed doors for daring to treat them like a poor person.

You made the threat last week to throw him in jail for another violation of the gag order. He violated it and you just slapped him with another fine. You can roar and growl behind closed doors, but what the public sees and hears is that the defendant is being treated as above the law.

I was listening to last week’s This Week in Tech podcast and one of the guests was Kevin Rose, a guy who essentially is a former podcaster, now angel investor gazzillionaire.

The subject of AI came up, as always, and Rose pointed out that he is always exceedingly polite to whatever AI client he’s using. Why? Because, I shit you not, he’s worried if it becomes sentient, AI in all its forms is keeping an enemies list, and he doesn’t want to get Terminated.

Real Simpsons-style “I, for one, welcome our new AI overlords” stupidity.

That’s just one sample. Almost always when TWiT has some level of Silicon Valley entrepreneur on the show, they vomit the most fucking idiot shit possible and actually believe it.

So Jack Dorsey saying something idiotic like “Twitter is freedom tech” doesn’t surprise me one iota.

I get really worried that a lot of the tech shaping our world is created and run by rich white male lunatics who are completely out-of-touch with reality.

I was being semi-sarcastic about the Secret Service, but I still worry about them having MAGAts in their midst, who still see “their” President as Orange Julius Caesar.

You know that news item last week where two of VP Harris’s detail got in a fight, and one was removed from active duty? Calling it now: the benched guy either threatened Harris or loudly proclaimed loyalty to Trump.

Admittedly, if he actually threatened the VP, he’d be in jail. In theory at any rate. I could see that happening and then the Service trying to cover it up.

This is the same agency that let an armed man get on an elevator with Obama, and had to reprimand two agents for driving drunk and blowing out tires on the White House driveway, by driving over those one way spikes.

Anyways, the short story is I really, really worry about where the loyalty of uniformed Americans with guns in this country lies.

Because outside of this blog, I’ve never met a liberal or Democratic cop or solider.

The closest analog we’d have with Trump’s malfeasance in the courtroom and violations of the gag order(s) would be mob bosses or gang members who threaten witnesses or jurors or court officials. It is not common.

Gag orders are not uncommon, as the parties will try to keep certain issues from being litigated in the media, rather than the courtroom, but Merchan’s gag order isn’t limiting the media- it’s telling Trump to stop making statements that threaten jurors, intimidate witnesses, etc. And those kinds of gag orders are likely to be upheld because of the interplay between the 1st and 6th Amendments (now subject to how the seditious six SCOTUS respond to the issue if it comes before them).

That would probably be the best analogy for the way that judges have approached Trump, not as a politician or as a rich asshole but as a mob boss whose prosecution must be air-tight lest the ratfuck find the smallest hole in which to wriggle through. Which also includes giving him unlimited “second chances” if only to avoid any accusation whatsoever during appeals of bias or malicious actions.

I should say that it is not common that you have a billioniare (or multimillionaire) who openly threatens witnesses, jurors, and the legal system. None of this is common.

It’s all unprecedented, and every step of this is breaking new ground on what to do.

How would I have treated all of this? Treat him like every other common criminal who engages in violent rhetoric and violates the gag order and conditions of bail - throw him in Rikers after the first fine.

In hindsight, it’s easy to see that people who work for Elon Musk should have started looking for something better back when he went nuts over the rejection of his stupid submarine idea. It’s been all downhill from there.

Tesla sends out another wave of layoff notices as employees enter 4th week of job cuts

Elon Musk continues to cut deeper at Tesla. The company sent out another round of layoff notices on Sunday night, according to impacted workers who posted about the cuts on social media.

The latest round of cuts mean that employees at the company are entering their fourth straight week of layoff notices. At least seven Tesla workers took to LinkedIn to say they’d received layoff notices on Sunday.

“After watching my team gradually slimmed down week after week since mid-April, I received the dreaded ‘Hello Employee’ email this Sunday afternoon,” one Tesla worker wrote on LinkedIn.
Another worker shared a screenshot of her layoff email on LinkedIn that showed her last day of work would be May 5.

A spokesperson for Tesla did not immediately respond to a request for comment ahead of publication.

Workers at the carmaker previously told Business Insider the continual waves of layoff notices had left them on edge, with many looking for opportunities outside of the company.

“I keep waiting for Elon to send another email and tell us they’re finally done firing people,” one current Tesla worker, who requested anonymity to speak on the conditions of their employment, said. “We need some level of closure or a sign that we can stop worrying about losing our jobs.”

And that’s really the issue here, any rich defendant would have heeded the advice of his high-priced lawyers and gone silent from the moment he was indicted until the moment after the verdict was handed down. They wouldn’t run out to the press during lunch time or at the end of the day’s session to whine about the judge, his daughter, the jury, the government, etc. They would be stone-faced, would respond to press questions with variations of “No comment,” and avoid the public spotlight as much as possible. The idea would to do anything and everything to avoid even the suggestion that they were trying to influence the trial.

re: #37 Targetpractice

If prosecutors call for revocation of bail or jail for the next violation of the gag order, the Judge would take that into account. The Judge isn’t going to go directly to jail when prosecutors haven’t called for that at this time. Bragg doesn’t want to necessarily jeopardize the trial with Trump knowing full well how Trump would likely seek an immediate appeal questioning the gag order on him, when anyone else in his position would have already been in jail. It’s a very defensive posture, which is unusual for a DA’s office that typically prosecutes aggressively.

It’s a risk-adverse strategy, one taking into account that Bragg can’t trust the appellate courts not to hand Trump a lifeline by putting the trial on pause for weeks or even months while they “carefully” consider yet another appeal that would have been stomped flat for most any other defendant.

MIT will no longer require diversity statements in its faculty-hiring process, making it the first elite university to abandon the practice.

The decision was made by MIT president Sally Kornbluth, with support from the school’s provost and six academic deans, a spokesperson told National Review on Sunday afternoon.

“My goals are to tap into the full scope of human talent, to bring the very best to MIT, and to make sure they thrive once here,” Kornbluth said in a statement provided to NR. “We can build an inclusive environment in many ways, but compelled statements impinge on freedom of expression, and they don’t work.”

I’m absolutely stunned he gutted the whole Supercharger team. That was the one thing that helped elevate Tesla above all EV makers: a reliable charging network that is just about everywhere in the US.

Just about every car manufacturer in the US within the last year pledged to move over to the Tesla standard. I’ve been advising the EV-curious to maybe wait until that port starts rolling out in non-Tesla vehicles before they buy something.

And he then fucking guts just about the entirety of that unit. That move is beyond insane.

They know everyone on the witness list (that’s been known for a while). They just don’t know when witnesses will actually testify.

Less than twenty four hours after the Israeli Defence Forces (IDF) dropped leaflets telling tens of thousands of people to flee eastern Rafah, Israeli forces have begun striking the area.

The IDF tweeted that they are “currently conducting targeted strikes against Hamas terror targets in eastern Rafah in southern Gaza.”

Palestinian news agency WAFA said Israeli airstrikes hit “roads, agricultural land, residential houses and animal farms,” in three neighbourhoods in eastern Rafah. The Turkish news outlet Anadolu reports that the Israeli army has intensified shelling on eastern Rafah.

If you’re watching international news about how Hamas supposedly accepted a ceasefire deal:
A ceasefire proposal modified by as-of-yet unclear parties was claimed by Hamas as accepted on their part, without Israel knowing any of its actual details. The US was by all accounts not consulted, and it’s not clear if Egypt was actually involved with it.
May well be info-op to put pressure on the US and Israel.
No real offensive in Rafah either - the IDF appears to have gone after a specific target (likely also to increase the pressure on Hamas). By all accounts, the forces gathered for a Rafah offensive have not moved.
My personal assessment: while the threat of a military move into Rafah - the last Hamas stronghold and where many of the hostages are believed to be held - is useful to put pressure on Hamas, I’d wager there’s little chance of the offensive before next week. Part of it is militarily: a substantial bulk of the reserve forces gathered for an offensive were sent home and the IDF likely won’t start before calling them back again. Another part is political: negotiations notwithstanding, Israel’s Memorial Day and Independence Day take place next week. While Netanyahu clearly no longer gives a damn about how he’s perceived internationally, he’s absolutely super cautious about how he’s perceived locally (~80% of the populace want him gone). Launching a major offensive in the week between Holocaust Remembrance Day and those two sensitive dates might be a really bad look for the ahole.

And those kinds of gag orders are likely to be upheld because of the interplay between the 1st and 6th Amendments (now subject to how the seditious six SCOTUS respond to the issue if it comes before them).

this is a state case
with federal implications
and election implications (past and future)
in a real sense it’s unprecedented.
every move, every step, every breath is big ‘news’

it would not be surprising to learn that at the state level, lots of well heeled people are treated with more deference than the average schlub. it’s just wouldnt be as ‘newsworthy’. plus i’d guess most people are not this egregious about it.

An Arizona State University senior, Breanna Brocker, expressed dismay upon learning she will miss her upcoming graduation due to a suspension stemming from her arrest at a campus protest. Brocker shared with @bdbrown473 that the suspension precludes her from participating in her final exams, directly impacting her ability to graduate as planned.

Brocker broke down in tears and played the victim card after learning she would not be graduating from the university this week.

Brocker voiced her frustration, highlighting the unforeseen consequences of her advocacy. “I’m a little disappointed. I’m being restricted from a lot of things right now that I didn’t expect to be for first standing up for something that I believe in.” The implications of her suspension extend beyond academic setbacks as she now faces the emotional task of informing family members, who were set to attend her graduation, to cancel their plans.

Ole Miss fraternity expels member after viral video of him making monkey noises towards Black woman

A University of Mississippi fraternity has expelled a student who was caught on camera making monkey noises at a Black protester during a Gaza solidarity demonstration.

The shocking incident was captured on video, and showed the white student, a counter-protestor, jumping up and down, making monkey sounds toward the protester who was live-streaming on her phone.

Referring to Black people as monkeys is a known racist trope dating back hundreds of years and used to justify slavery and Jim Crow law.

The Phi Delta Theta fraternity said that it had reviewed the incident, which received widespread condemnation, and that the individual’s actions were “unacceptable”. The student was not named.

“The past few weeks have been challenging for many colleges and universities across the United States as they struggle to balance the protection of free speech with maintaining appropriate and respectful discourse among demonstrators and others within the campus community,” the fraternity said in a statement.

I’ve refined my idea about it being a good idea to sentence Trump to roadside cleanup rather than jailing him for contempt.

Since $1000 fines mean nothing to him he should be required to clean up garbage for as many hours would add up to a grand if being paid minimum wage. Let him feel how costly $1000 feels to so many folks.

And let him work in the sweltering heat rather than sit on his fat ass for once.

Make sure Federal (and if applicable), State taxes are withheld as well. The MFer has never paid the “common mans” taxes.

This is a superlative idea. In fact, I think it should be done across the board for all fines levied vs. people too rich to feel the pain of a fine — they work off the fine via manual labor at prison chain gang rates (rather less than minimum wage, IIRC, but fuck it).

To prevent any accountant trickery for this, just double the work time to account for the tax issue. Let this pigfucker for once feel the pain of paying taxes on earned income.

Scoop: Kristi Noem angled for top NRA job

South Dakota Gov. Kristi Noem (R) pitched herself for a top NRA job as early as last fall, two sources told Axios.

Why it matters: Noem offered to step down early as governor for the role, according to a person familiar with her conversation with former NRA CEO Wayne LaPierre.

Late last fall, Noem called LaPierre to advocate to be the next executive vice president or CEO of the gun lobby.

And mob threats or bribes to jurors tend to be sub rosa.

Unknown to us, a juror was bribed in a fed case in NJ, that found our client and numerous co-defendants not guilty. FWIW, Alito was the AUSA.

It took a while for the feds to figure out which juror. Meanwhile our guy decided he had paid enough for his criminal defense, and we withdrew from further representation.

The whole jury acquitted your client? Then he must have been very persuasive to change the votes of everyone on the jury. Or was it a hung jury?

Yeah, the utter lack of curiosity by the press about how the largest police force in the US is manufacturing consent using their platforms does not speak to a healthy political future.

NYPD promises to “use the might of our Intelligence Bureau and our Federal partners” to find the “unknown entity who is radicalizing our vulnerable students.”

Nathan Kalman-Lamb (@nkalamb.bsky.social) 2024-05-05T09:49:45.457Z

But then again we turning this into a hybrid Satanic Panic/War on Terror scary story session. We’re officially at the step where libs are willing to entertain the classic “it was aliens and weirdos infiltrating” step of moral panic.

And as always…it’s the same people that scoffed at the possibility that the speech of the alt right was threatening, but clearly we must treat this contradiction as merely an oversight and not part of a continuing trend in the simplest resolution to the contradictions of our society is to simply decide *fuck them kids*.

In any group protesting for something good, if there’s a single objectionable thing said or done, the entire protest is illegitimate. But in a group of torch-bearing fascists, if there’s even one person I think has a valid complaint, the entire group must get a sympathetic hearing.

Quoting Justice Brett Kavanaugh’s statement in his Dobbs concurrence that the “the constitutional right to interstate travel” would make an attempt to ban travel to obtain an abortion “not especially difficult [to resolve] as a constitutional matter,” Thompson, a Carter appointee, concluded on Monday in a 98-page opinion that “the plaintiffs here correctly contend that the Attorney General cannot constitutionally prosecute people for acts taken within the State meant to facilitate lawful out of state conduct, including obtaining an abortion.”

It reminds me of how MAGAs have tried to say that Trump didn’t call Nazis “very fine people” after Charlottesville because there were people there protesting the removal of the Robert E Lee statue who weren’t Nazis.

The problem is, if there were actually non-Nazis there, they still went to a rally that was of, by, and for Nazis.

re: #158 The GOP is a Terrorist Organization

Every time the US does something ugly…or just gets caught…somebody will say “this is not who we are” and that’s sufficient repentance for the half the population that wants us to be good and moral. But the other half of the country has always felt “no this is who we area and there’s nothing to repent for because our goodness and moralness are immutable qualities.”

Trump speaks directly to that second group, but he’s also preferable to anyone that says “this is who we are and we must change” for the first group.

Finish cooking the fettuccine in melted butter
Let it absorb the butter as it cooks.
Add warm half & half to taste

Grated parmigianoto regginao to taste

Maybe thrown in some cooked shrimp

If you (delay the trial by appealing incarceration for violation of gag order) have a monkey wrench, ya gotta know when it use it.
